The questioner : She says: If the husband says, “If you want to stay with your children, do so; otherwise, go to your family, and you have nothing from me,” what is the ruling?

The Shaykh : If he gives her this choice, he has absolved himself of responsibility.

The questioner : Yes.

The Shaykh : He has absolved himself of responsibility. For this reason, Sawdah bint Zam‘ah (may Allah be pleased with her), one of the Mothers of the Believers, when she feared that the Messenger of Allah (peace and blessings be upon him) would divorce her, gave her day to ‘A’ishah (may Allah be pleased with her) so that she would remain with the Prophet (peace and blessings be upon him).

The questioner : Yes.

The Shaykh : So the Prophet (peace and blessings be upon him) would allocate to ‘A’ishah her day and Sawdah’s day. Thus, if a man gives his wife this choice and says, “I am unable to be just between you two, so either you grant me permission and absolve me, or I will divorce you, or I will allow you to go to your family,” or something similar, if this happens, he has absolved himself of responsibility.

The questioner : Yes.

The Shaykh : Yes.

The questioner : This message is from the sender, ‘Abd al-Karim Muhammad al-Maliki, from the land of Banu Malik, Social Security Office. In this message, he presents a problem regarding breastfeeding.
