The Ruling on a Divorced Woman Remaining with Her Children at Her Father's House

Machine translationRead the Arabic original
Question:
In her second question, she states: "I am a divorced woman living with my children in my husband's house. Is it permissible for me to remain in his house, or must I leave? And is it permissible for me to eat from the food that the husband prepares for my children? May Allah reward you with good."

Answer:
Yes, there is nothing wrong with her remaining with her children, provided it is in a manner that involves no seclusion and no trial. As for if the divorce is revocable, there is nothing wrong; in fact, it is the recommended practice, indeed the obligatory one. Allah, Exalted and Majestic is He, said:
nor shall they go outوَلا يَخْرُجْنَ
[Al-Talaq:1] He said:
Do not turn them outلا تُخْرِجُوهُنَّ
[Al-Talaq:1] So, if the divorce is revocable, whether one or two pronouncements, she should stay in case he takes her back. If it is the final pronouncement, or a divorce by mutual consent, then if she stays out of necessity in a manner that does not involve seclusion with her children, there is no blame on her. And if she leaves to another place to avoid trial, there is nothing wrong with that. However, some women may need to do this; she may have no one else, so she remains with her children and sits with them, but he does not seclude himself with her. There is nothing wrong with him speaking with her or her speaking with him, but with the hijab and without seclusion. Yes.
