Ruling on leaving off the stoning of the pillars or stoning them before the sun passes its zenith
Machine translationRead the Arabic original
Many pilgrims booked their flights for the thirteenth day, intending to return on the twelfth. Perhaps Dhu al-Qi'dah turned out to be thirty days, making the thirteenth day the twelfth. So many of them hastened and stoned the pillars before the sun passed its zenith in order to catch their flight. So do we say: Can they stone and then travel? The Shaykh: Now, the difference is not a matter of hours; the difference is a day.
The questioner: Some of them booked for the thirteenth day, and then the thirteenth day became the twelfth.
The Shaykh: Why don't they postpone the flight? The questioner: There is no booking available, and many of the pilgrims who book flights are in this situation.Does this mean: If they do not stone the pillars before the sun passes its zenith, they will not catch the plane.
The Shaykh: In this situation, I see that they should go down to Makkah, perform the farewell circumambulation, and walk. The one who comes [to Makkah] should slaughter a fidyah for leaving the obligatory act, which is the stoning.
The questioner: What is dropped from them?
Nothing is dropped from them, because it is obligatory.
The questioner: Some scholars permit elderly women or the elderly, in the case of a crowd, to stone before the sun passes its zenith if such unexpected circumstances arise.
The Shaykh: I do not see this, because the Prophet (peace and blessings be upon him) did not grant a dispensation to the weak ones, to whom a dispensation was granted on the day of 'Id, to stone before the sun passes its zenith. If the Messenger (peace and blessings be upon him) did not grant a dispensation despite the presence of the cause, this indicates that it is not permissible. But we say: They are now restricted, like the one who is restricted, restricted from performing the obligatory act.And Allah the Exalted said: [al-Baqarah:196] This is the closest thing.
The questioner: Does he slaughter it in Makkah? The Shaykh: In Makkah, or he may appoint someone to do it; there is no harm in that.
