The Shaykh : It is obligatory for us to know that if the principal loses his mind, either due to a mental deficiency that is not expected to be cured, or due to insanity—may Allah protect us from it—then the agency is dissolved. It is not permissible for him to dispose of the money, neither by paying zakah, nor by selling or buying, nor by anything else. That is to say, the agency is dissolved if the principal’s ability to act ceases due to insanity, a disorder in thinking, or something else, or due to a fainting spell that is not expected to end. Based on this, it is obligatory for the one who has this woman’s money in his possession to give it to her responsible family members, or to obtain a new agency from the court.
