This questioner says: O honorable Shaykh, I ask Allah the Great, Lord of the Mighty Throne, to make me, you, and all Muslims among those who fast the month of Ramadan and stand in night prayer in the manner that pleases Him. O honorable Shaykh, as you know, fasting and abstaining are now based on the calendar, which relies on calculation rather than sighting the dawn and the setting of the sun, so my question to you, O honorableThe Shaykh : If I hear the mu'adhdhin and I have a mouthful of food in my hand, do I eat it or leave it? Please give me a ruling, may Allah reward you with good.

The Shaykh : There is no doubt that Allah (Glorified and Exalted is He) tied abstaining and breaking the fast to tangible, horizontal signs. Abstaining is tied to what? Answer, everyone? To the rising of the dawn. So when the dawn rises and you see it, you must abstain, whether the adhan is called or not. And when the adhan is called but the dawn is not clear, you have the right to eat. But it is well known that we cannot see the dawn now, because the city is lit up with lights, and most people are in their homes and do not see it. So out of caution, if you hear the mu'adhdhin, you should abstain. But there is no blame on you if you eat the mouthful of food in your hand or drink the cup in your hand. As for the setting of the sun, it is the same. Breaking the fast is tied to what? To the setting of the sun. The Prophet (peace and blessings be upon him) said:
When the night approaches from here, and he pointed to the east, and the day departs from here, and he pointed to the west, and the sun sets, then the fasting person has broken his fast. إذا أقبل الليل من هاهنا وأشار إلى المشرق، وأدبر النهار من هاهنا وأشار إلى المغرب، وغربت الشمس فقد أفطر الصائم
So if you happen to be in a high place and you see that the sun has set, then break your fast, whether the adhan is called or not. And if you happen to hear the adhan while you are in a high place but you can see the sun, it is forbidden for you to break your fast, because the criterion for breaking the fast is the setting of the sun, and the criterion for abstaining is the clarity of the dawn.
