We said to him, "Subhan Allah," so he immediately sat down and performed the sitting, then stood up for the third rak'ah and completed the prayer. Some of us asked him, "How did you return from the obligatory to the recommended?" He answered, "I did not begin with the recitation, so I returned to the sitting." Please advise us on his action. May Allah reward you.

The Shaykh : His action is contrary to what the Prophet (peace and blessings be upon him) commanded, because if a person stands up from the first tashahhud and is fully standing, he does not return. He must perform the prostration for forgetfulness (sujud al-sahw) with two prostrations before the taslim. This is what the Prophet (peace and blessings be upon him) did when he led his Companions in the Zuhr prayer; he stood up from two rak'ahs without sitting. When he finished the prayer and the people were waiting for his taslim, he said takbir while sitting, prostrated twice, and then said taslim. It was also narrated from the hadith of al-Mughirah ibn Shu'bah that the Prophet (peace and blessings be upon him) said:
but if he has stood up fully, then let him not sit down فإن استتم قائماً فلا يجلس

Therefore, the rule is that if a person stands up from the first tashahhud until he is fully standing, he does not sit, but it is obligatory for him to perform the prostration for forgetfulness with two prostrations before the taslim.
