The second question of fatwa number ( 19673 )
Q2: If I was the imam in a mosque and I did not sit for the first tashahhud, and the congregation reminded me while I had already fully stood up, and I completed the prayer and prostrated for forgetfulness before the taslim, is my action valid or not?
A2: The first tashahhud is obligatory among the obligations of the prayer. If the imam leaves it out due to forgetfulness, and he remembers it or the ma'mumun remind him of leaving it out before he has fully stood up, it is obligatory for him to return to it and perform it. If he has fully stood up, it is disliked for him to return, even if the ma'mumun remind him. If he begins the recitation, it is forbidden for him to return to the first tashahhud; because he has engaged in a second pillar, which is his beginning the
recitation of al-Fatihah, so it is not permissible for him to leave it for an obligatory act, and the obligatory act is compensated for by sujud al-sahw. What you did of completing the prayer and not returning to the first tashahhud after you had fully stood up, and your prostration for forgetfulness before the taslim, is valid, and it is in accordance with what is established from the Messenger of Allah (peace and blessings be upon him) in the hadith of al-Mughirah ibn Shu'bah (may Allah be pleased with him), that the Messenger of Allah (peace and blessings be upon him) said:
When one of you doubts and stands at the end of two Rak'at, if he remembers while having stood up completely he should continue and should not return (to the sitting position) and he should make two prostrations, but if he did not stand up straight he should sit down and there is no forgetfulness (prostration) upon him.إذا شك أحدكم فقام في الركعتين فاستتم قائمًا فليمض وليسجد سجدتين فإن لم يستتم قائمًا فليجلس ولا سهو عليه
Bulugh al-Maram 2:238
, narrated by Abu Dawud and Ibn Majah and al-Daraqutni , and in the hadith of 'Abdullah ibn Buhaynah (may Allah be pleased with him):
The Prophet (ﷺ) led them in the Zuhr prayer, and when he stood up at the end of the first two Rak'at and did not sit, the people stood up with him. When he finished the Salat (prayer) and the people expected him to do the Taslim (salutation), he uttered the Takbir while sitting and made two prostrations before saying the Taslim (salutation), then he uttered the Taslim (salutation).
Bulugh al-Maram 2:225
, reported by the seven. And this
is the wording of al-Bukhari . And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
