The questioner : In the statement of 'Ali ibn Abi Talib: I heard it but I did not read it in your book. It says that the Messenger of Allah (peace and blessings be upon him) sent a man to him who complained to him that his wife was committing fornication. The Messenger of Allah (peace and blessings be upon him) said to him: "Divorce her." He said: "O Messenger of Allah, I love her." He said: "Divorce her." He said: "Who told you that she has children?" He said: "Go to 'Ali." This narration, I heard it; I heard it but I did not read it.

The Shaykh : Yes

The questioner : So when he went to him and related the story to him, he said two lines of poetry: "Indeed, the Messenger is jealous, and Allah is more jealous than he. How terrible is the wrath of one whose jealousy has lasted so long." Does this mean that the *dhiyy* deserves to be killed?

The Shaykh : Establish the Throne, then inscribe after establishing the story. This question comes, and Allah knows best about it. But this story seems to be built upon a correct incident. The correct incident is in the *Sunan* of al-Nasa'i and others with a sound chain of narration that a man came to the Prophet (peace and blessings be upon him) and said: "My wife does not turn away the hand of a toucher." He said to him
Divorce her طلقها
. He said to him: "I love her, O Messenger of Allah." He said: "Then hold onto her." That is how the hadith is, only that. Some people understood from the husband's statement about his wife, "she does not turn away the hand of a toucher," that she is... committing fornication. But it appears that the matter is not so, because if the husband accused his wife of zina, he has to do one of two things: either he establishes witnesses and the hadd is carried out against her, or the hadd of... And none of this happened at all in the incident. The evidence is that the husband's statement "she does not turn away the hand of a toucher" does not mean accusing her of fornication, but rather it means, as is known in some stories, especially in some villages... a young man talks to a young woman and leaves, and she does not care about it. So it appears that this wife was like that, and the husband was jealous, so he complained to the Messenger of Allah: "She does not turn away the hand of a toucher."

The questioner : Meaning, shaking hands.

The Shaykh : And what about now? The calamity is this handshaking. The Muslim girl today does not scruple, even the ones who wear the hijab. Because in reality, this is a problem now: many Muslim women think Islam is the hijab. Nothing changes in them except that they threw on this garment, but their walk is the walk of a man, their boldness in speech, their mixing with men, it remains as it is. So look, this husband who sees his wife extending her hand to shake his before he extends his hand to her says: "My wife, or my woman, does not turn away the hand of a toucher." The judgment is with you, so divorce her. "I love her." "Then hold onto her." It is better that he divorce her, but in the path of obtaining the best, he fell into another problem. He will divorce her and his heart will go after her, just as the heart of Mughith went after that woman, Barirah, when she became free. So the Messenger of Allah (peace and blessings be upon him) gave her the choice between staying with him or becoming free. She said: "I do not want him." So whenever she went out to attend to a need in the market, he would walk behind her, weeping, weeping for her separation. What can he do? He loves her. So he said to him
Keep her أمسكها
. He said to him: "Divorce her." He said to him: "I love her." He said to him
Keep her أمسكها
. Meaning, this hadith can be included in taking the lesser of two evils. And peace be upon you and the mercy of Allah and His blessings.

The Shaykh : But this, our Shaykh said.

The questioner : That we should transmit?

The Shaykh : But is your observation regarding the statement
Our Shaykh saidقال شيخنا

The questioner : Yes, the word
Our Shaykh شيخنا
. Does it require that he sit with Shaykh Nasir al-Din al-Albani and learn from him until he permits him?

The Shaykh : I studied the hadith and it became clear to me that it is hasan or sahih.

The questioner :
When someone whose religion and character you are pleased with comes to you then marry (her to) him إذا جاءكم من ترضون دينه وخلقه فزوجوه
Jami` at-Tirmidhi 1085Da'if (Darussalam)
This is a hadith, Allah knows best, that its paths are in the last path.

The Shaykh : This is strong with the others.

The questioner : He narrated it from his father in Muslim.

The Shaykh : It has two paths. Let us branch out for the sake of knowledge, if Allah wills, and publish it among you.
