The questioner : A female questioner says, "May your excellence...The Shaykh : I am a woman married to a man who leaves off prayer for a month or two and does not pray the Friday prayer. One night I refused him in the bedroom, and a dispute arose between us, so he divorced me twice. I am in a state of confusion and I fear that what is between us is forbidden, so guide me, may Allah reward you with good, and guide men like these? Knowing that my father does not know about any of this?
The Shaykh : The man who does not pray at all, neither the Friday prayer nor any other, is a disbeliever, and it is not permissible for a woman to remain with him for even a blink of an eye, due to the saying of Allah, Blessed and Exalted is He:[Al-Mumtahanah 60:10]. As for the man who prays and then leaves it off, meaning he sometimes prays and sometimes does not, what I see is that he is not a disbeliever, but he is an open sinner, may Allah protect us from that. In this situation, the woman has the right to demand the annulment of the marriage, and it is better for her, if she has lost hope in his reform, to demand the annulment of the marriage, because this will have a bad effect on her and on her children as well, if they see that their father is negligent in prayer to this extent, they will become negligent in it. But we ask Allah, Glorified and Exalted is He, for his guidance, that he may be guided to the right path, and that his wife may remain with him in happiness and success. Yes.
