What are the conditions for wiping over the leather socks?

Machine translationRead the Arabic original
Eid Abbasi : In the question: What are the characteristics of the socks that permit wiping over them according to the authentic hadiths? And is it permissible for the resident to wipe over them whenever he wishes?

The Shaykh : There is no restriction or condition in the Sunnah regarding the sock over which the Messenger (peace be upon him) wiped. Wiping over socks is like wiping over leather socks. When the wise Lawgiver, through the words or actions of His Prophet, permitted wiping over leather socks and wiping over socks, He did not stipulate any condition except that it be a leather sock or a sock.
Therefore, the conditions mentioned in some books of Islamic jurisprudence, despite the extensive disagreement among them and between them, do not contain any condition explicitly stated in the texts that obligates adhering to it, except for what came in the authentic hadiths from his saying (peace be upon him):
The resident wipes over the leather socks for one day and one night, and the traveler for three days and their nights
; this is the only condition that came in the authentic Sunnah. This includes the answer to the last condition in the question, which is that the resident does not have the right to wipe without a time limit after the Messenger (peace be upon him) set a limit for him to wipe for one day and one night, and for the traveler for three days and their nights only.
For this reason, there has been disagreement among scholars, both ancient and modern. Some permit wiping over socks with conditions that, if one were to insist on adhering to them, would cause us to lose this dispensation entirely due to the harshness of the conditions they imposed. For example, they require that the sock be thick; meaning it has a sole at the bottom. Some were lenient regarding this condition and did not count it, but they required that the sock be thick. Those who stipulated this differed in defining thickness, with some saying it is what stands on its own, and others saying it is what one can walk on for about half an hour, and so on. Thus, they differed, which indicates that this disagreement is not from Allah (Mighty and Majestic). This is the text of the Qur'an:
If it had been from [any] other than Allah, they would have found within it much contradiction.
[An-Nisa 4:82]
. This leads us to remind you that the famous hadith: "The disagreement of my Ummah is a mercy" has no basis in the Sunnah. Disagreement is not a mercy, but a calamity.
Finally: The path of the investigating scholars ended, after this long and extensive disagreement, with what Imam al-Nawawi mentioned in his great book "Al-Majmu' Sharh al-Muhadhdhab" regarding 'Umar ibn al-Khattab, that he wiped over thin socks. 'Umar ibn al-Khattab wiped over thin socks. It is customary to cite such an occasion as evidence that 'Umar ibn al-Khattab was one of the Rightly Guided Caliphs, and we have been commanded to follow their example. He is undoubtedly a model to follow here, because there is nothing in the Sunnah that contradicts what Imam al-Nawawi mentioned about 'Umar ibn al-Khattab. Rather, the general permissibility of wiping over socks in the Shari'ah; this generality includes any sock, whether thick or thin, whether transparent or opaque. Because they also, among the conditions they emphasized, required that water not pass through it to the foot. This is also one of those conditions. It is sufficient for you to recall with me the saying of the Messenger of Allah (peace and blessings be upon him):
Every conditions that is not in the Book of Allah (SWT) is invalid, even if there are one hundred conditions
Sunan Ibn Majah 2521Sahih (Darussalam)
. This is clear speech, because any ruling in the Shari'ah that came in a general form, whether it was an obligation, a prohibition, or a dispensation, when a person comes and imposes a condition on all of that from his own opinion, he has nullified the ruling from its root. So if it is said that the Messenger (peace be upon him) granted a dispensation for wiping over socks, and then a person comes and says: "But with such and such a condition; that it be thick, for example," and this has been said, it would be of the socks that we no longer wear today, the ones that are hand-knitted at home from thick spun wool. Yes, where are we to find this? It means that one should not wipe over socks, because a condition has been imposed that we cannot now, or it is difficult for us now, to fulfill.
Therefore, this condition is not permissible to be imposed except by the command of Allah or His Prophet (peace be upon him). So as long as no condition has come, we are absolutely, wiping over socks, wiping over leather socks; praise be to Allah, Lord of the worlds, as He said:
And never is your Lord forgetful -
[Maryam 19:64]
, and as in a hadith whose chain is weak, but its meaning is supported by the previous verse:
And He was silent about matters
What is the beginning of the hadith?

Eid Abbasi :
God has made certain things binding
Mishkat al-Masabih 197Isnād Da'īf (Zubair `Aliza'i)
.

The Shaykh :
Indeed, Allah has prescribed obligations, so do not neglect them, and He has set limits, so do not transgress them, and He was silent about matters out of mercy for you, so do not ask about them
.

Those present :
Not out of forgetfulness
.

The Shaykh : Yes?

Those present :
Without any forgetfulness
.

The Shaykh :
Without any forgetfulness; so do not ask about them - or do not investigate them - من غير نسيان ؛ فلا تسألوا عنها - أو لا تبحثوا عنها -
.
Therefore, these conditions, if Allah (Mighty and Majestic) had wanted them to be prescribed for His servants, He would not have forgotten them, but rather He legislated them. So as long as He has not legislated them, we are on the absolute dispensation. The best book compiled on this topic specifically regarding wiping over socks and the conditions mentioned therein is the book of the Shaykh "Jama' al-Din al-Qasimi," which is "Wiping Over Socks." It is, in fact, a book that collected the opinions of scholars and discussed them with knowledge and jurisprudence. I commented on it and authenticated it, and added an appendix at the end, in which I clarified some rulings that are also important for the one who acts upon this dispensation. For example, when does the wiping begin and when does it end? So whoever wishes to expand his knowledge should refer to this treatise.
