What is the easier option during the days of Tashriq?

Machine translationRead the Arabic original
The Shaykh : My brother, what is the issue that has two aspects in what you are currently doing, such that you choose what is easier? What is easier?

The questioner : For me, it is to hasten in two days, stay the night of the second day, and save on the stoning.

The Shaykh : Is this the easier option according to the Shari'ah?

The questioner : It is easier for me.

The Shaykh : No, what is easier for you? I am asking you about the Shari'ah? Because everyone has a personal inclination. What is your opinion if someone stoned the large Jamarat al-Aqabah and said, "The easier option for me is to complete the Tamattu' with my ticket"?

The questioner : It is not valid. No, I neglected the ritual by leaving the overnight stay in Mina, and it is obligatory.

The Shaykh : How is the overnight stay in Mina?

The questioner : The nights of the first and second of the days of Tashriq.

The Shaykh : Okay, regarding the overnight stay in Mina, which nights is it obligatory to stay in Mina?
The respondent : The nights of the first, second, and third.

The Shaykh : Okay, and you?

The questioner : And I stayed the nights of the first and second.

The Shaykh : And the third?

The questioner : I am hastening, and I stayed the third night, and in the morning I left before the sun reached its zenith.

The Shaykh : It is permissible if it was a mistake on your part. We set aside the day of Eid, so there remain three days of Tashriq, and you hasten as mentioned in the verse.

The questioner : Yes, in two days as in the verse.

The Shaykh : Meaning you spend two days of Tashriq and then hasten, and you do not spend one day of Tashriq?

The questioner : One day of Tashriq and the second day.

The Shaykh : Answer me, may Allah guide you. You spend two days of Tashriq, and at the end of the second day of Tashriq you hasten, is that how it is?

The questioner : At the beginning of the second day of Tashriq, meaning I do not stone on the second day, but I stay its night.

The Shaykh : When is the prescribed hastening? In the morning or in the evening?

The questioner : In the evening, at the end of the day.

The Shaykh : Do you do it this way?

The questioner: No.

The Shaykh : So what are we talking about? The prescribed hastening, by which our Lord made it easy, so He said:
Then whoever hastens [his departure] in two days - there is no sin upon him فمن تعجل في يومين فلا إثم عليه
[Al-Baqarah 2:203]
Meaning, stone the Jamarat on the second day and then depart without intending anything else. You do not want to merely enjoy this dispensation, but you want to add to it. That is why I told you, what is the difference between you and the one who hastens on the first day of Tashriq? That is what you are doing.

The questioner : He did not stay the night.

The Shaykh : There is no difference between the overnight stay and the stoning; both are obligatory.

The questioner : But I came for the overnight stay and remained until the morning, before the stoning.

The Shaykh : I understand that you came for the overnight stay, but I understand that there is no difference between the overnight stay and the stoning. So you want to neglect an obligation, which is the stoning, on the pretext of what? "Whenever I am given a choice between two things, I choose the easier one." This is a fallacy against yourself. Where is the choice here? You are given the choice to stone and to depart, and you want not to stone and to depart. Do not deceive yourself, and fear your Lord.

The Shaykh : How are you, okay? Welcome.
Abu Layla : Praise be to Allah, a good piece of advice.

The Shaykh : May Allah accept it, and may he not follow his own inclination, because unfortunately, despite his goodness, he has not accustomed us to going against his own inclination. That is, whenever a discussion takes place on a matter, he follows his inclination and does not follow the text of the Shari'ah.
Abu Layla : There is no power nor strength except with Allah.

The Shaykh : May Allah guide us and him.
Abu Layla : Amen,
