The Shaykh : First, it must be known that it is not permissible for a person to pass the miqat while intending Hajj or 'Umrah unless he enters the state of ihram from it, because the Prophet (peace and blessings be upon him) designated the miqats and ordered those who reach them intending Hajj or 'Umrah to enter the state of ihram from them.
Second, if a person does this, meaning he passes the miqat without entering the state of ihram while intending Hajj or 'Umrah, he has committed a sin and disobeyed Allah and His Messenger. According to the scholars, he owes a fidyah, which he must slaughter in Makkah and distribute to the poor, and he must not eat any of it, as compensation for the obligatory act of ihram that he left, since he left an obligation in the state of ihram, which is that the ihram must be from the miqat. Yes.
