The questioner : The father in Hajj stoned the pillars on behalf of his wife and his sister in the obligatory Hajj out of fear of the severe crowd; what is the ruling on this, O Shaykh?
The Shaykh : The ruling is that it is not permissible for a person to appoint someone to stone the pillars on his behalf. If that were permissible, the Prophet (peace and blessings be upon him) would have allowed the weak among his family to appoint someone to stone the pillars on their behalf and to delay in Muzdalifah until they depart with the Prophet (peace and blessings be upon him and his family). If appointment were permissible, the Prophet (peace and blessings be upon him) would have allowed the shepherds to appoint someone to stone the pillars on their behalf. Stoning the pillars is part of the parts of Hajj. And Allah the Exalted said:[Al-Baqarah 2:196] The negligence of people in this today has no justification. I mean that some people are negligent in stoning the pillars; you find one appointing someone to stone on his behalf without necessity, but he wants not to be tired, he wants to rest, he wants to make Hajj a leisure trip. And this is a great error.
And the one who appoints another to stone the pillars on his behalf while he is capable, the stoning on his behalf is not valid, and upon him, according to the scholars, is a fidyah (ransom payment) that is slaughtered in Makkah and distributed to the poor.
As for the issue of the crowd, the problem of the crowd has a solution, and it is that instead of stoning at the time of the crowd, he can delay until the end of the day, until the beginning of the night, until midnight, until the end of the night, as long as the dawn of the second day has not appeared. But most people, as I said, are very negligent in the matter of stoning the pillars. Yes.
The questioner : This, O Shaykh Muhammad (may Allah preserve you), is in the obligatory and in the voluntary?
The Shaykh : There is no difference between the obligatory and the voluntary.
The questioner : Yes, good.
The Shaykh : Because the voluntary must be completed, as Allah the Exalted said:[Al-Baqarah 2:196] And this was before the obligation of Hajj was revealed.
The questioner : May Allah reward you and bless you, O honorable Shaykh.
The Shaykh : The ruling is that it is not permissible for a person to appoint someone to stone the pillars on his behalf. And complete the Hajj and 'umrah for Allah
