The questioner : I performed the obligatory Hajj, and praise be to Allah, but I did not stone the Jamarat al-Aqabah due to the severe crowd, and I appointed my husband to stone on my behalf. During the stoning of the remaining pillars, I was ill, so we stoned on some days, but I was unable to stone on some of the other days, so my husband stoned on my behalf. Do I owe anything for this? Please advise us, may you be rewarded.

The Shaykh : As for the days on which your husband stoned on your behalf while you were ill, his stoning is sufficient, if Allah wills. As for the days on which he stoned on your behalf while you were not ill, but you were afraid of the crowd, the crowd does not persist. The crowd occurs at the beginning of the stoning time, then it gradually decreases until it disappears completely, so there is no crowd. Even if, for example, tens or hundreds of people are stoning the pillars, this does not create the congestion that prevents one from performing the obligatory act of stoning. Therefore, appointing the husband in this situation is not permissible. Rather, one should wait until the crowd subsides, and then the woman should stone with her own hand. I see that as a precaution for this woman, she should slaughter a fidyah (ransom payment) in Makkah to be distributed to the poor there. If she does not have the means, then she owes nothing.

The questioner : May Allah bless you, O honorable Shaykh.
