The questioner : In his second question, this questioner says: I donated a sum of money, and this sum was a vow upon me. When I wanted to fulfill this vow, I sent half of the amount to my brothers so that they would deliver it to the poor people whom I had specified to give this amount to and distribute it among them. The brothers, when the half of the amount reached them, were in need of any amount that reached them, so they took it and did not give it to its owners. Now, is it obligatory for me to pay the full amount to those previously mentioned?

The Shaykh : It is not obligatory for you to pay this amount, but it is obligatory for your brothers to pay it, because they are guarantors for it. You have now taken the place of your brothers. It is not permissible for one who is trusted to betray the one who trusted him. It was obligatory for these brothers, when the amount reached them, to speak to their brother and say, "We are in need, so allow us to take it." If they were as they said and he allowed them, there is no harm. However, if he had specified certain names for them, but if he had promised those whom he specified, then it is obligatory for him to fulfill his promise, because breaking a promise is one of the signs of hypocrisy.
In summary, the answer is that we say: Your brothers are guarantors for the money they took, and they must pay it to those you designated for them. If they refuse, they are compelled to do so. Then, if you wish, give them [the money], and if you wish, do not give them.
Second, if you had promised those whom you specified and told them, "I will send you so much and so much," then fulfill the promise and seek recourse from your brothers for what they took. If you wish, forgive them.

The questioner : May Allah reward you and bless you.
