The Shaykh : That they be before the Fajr prayer. There are no obligatory rak'ahs before the Fajr prayer, because what comes before the Fajr prayer is a regular Sunnah, but this regular Sunnah is the best of the regular Sunnahs, due to the saying of the Prophet (peace and blessings be upon him):
The two Rak'ah of Fajr are better than the world and what is in it. ركعتا الفجر خير من الدنيا وما فيها
