The questioner : We are four brothers living with our father, whom Allah, Glorified and Exalted is He, has honored with this blessing, and we thank Allah for it. However, our father favors and shows kindness to our youngest brother because he is from a second wife, and he has written some properties in his name. What is the ruling on this?
The Shaykh : The ruling in this matter is that you must be dutiful to your father and be patient with the injustice that has occurred from his part, because you are commanded to be dutiful to your parents. As for your father, I warn him against this action and say to him: Fear Allah and be just among your children. He must return the properties he wrote in his son's name and the other matters in which he preferred his son, unless you permit it. If you permit it, there is no blame on him in letting these properties remain with the son he preferred over you. However, if you do not permit it, he must return what he gave, because Bashir ibn Sa'd al-Ansari (may Allah be pleased with him), when he gave his son al-Nu'man ibn Bashir a gift, the Prophet (peace and blessings be upon him) ordered him to take it back. He returned what he had given his son, when the Messenger (peace and blessings be upon him) said to him:Sahih al-Bukhari 2587 Yes.
