Is it permissible for a woman to take her money that is in the debt of her husband secretly from him?
Machine translationRead the Arabic original
The questioner : Noble Shaykh, if a wife has money with her husband and she is shy to ask for it, is it permissible for her to take from his wealth the amount he owes her without his knowledge, or not?
The Shaykh : What is the concept of the question?
The student: Yes.
The Shaykh : He says: This is a woman who has dirhams in the debt of her husband, and she is shy to ask the husband for the dirhams. Is it permissible for her to take the amount of her right from his wealth without his knowledge? The answer is no; it is not permissible for her to take from his wealth the amount of her right without his knowledge, just as all people of religion, all people of religion, do not have the right to take from the debtor the amount of their right. If someone asks: Did not the Prophet (peace and blessings be upon him) permit Hind bint 'Utbah to take from her husband's wealth the amount of her maintenance and her children's maintenance? The answer is yes, but there is a difference between a debt and maintenance. The cause of maintenance is apparent, which is the marriage, and it is known to all people that the husband must maintain his wife, and the father must maintain his children. This is unlike a debt; a debt is unknown and people do not know about it. So if the man is stingy and miserly and does not give his wife and children what suffices them, then the wife is permitted to take from his wealth without his knowledge the amount of maintenance for herself and her children, and she is not sinful. And here this session ends, and praise be to Allah, Lord of the worlds. And until a future meeting, if Allah wills, in another visit to this good place.
