Explanation of the Book of Friday and the Two Festivals-06b

Machine translationRead the Arabic original
The reciter: Adam narrated to us, Shu'bah narrated to us, Zubayd narrated to us, saying: I heard al-Sha'bi, from al-Bara' ibn 'Azib, who said: The Prophet (peace and blessings be upon him) said:
The first thing we do on this day is to pray, then we return and slaughter. Whoever does that has followed our Sunnah. And whoever slaughters before the prayer, it is only meat he has prepared for his family; it is not part of the ritual in any way. Then a man from the Ansar, known as Abu Burdah ibn Niyar, said: "O Messenger of Allah, I have slaughtered, and I have a one-year-old goat which is better than a two-year-old." He said: "Use it in its place, and it will not suffice for anyone after you."
.

The Shaykh : We have previously discussed many of its rulings, especially regarding his statement:
it will not suffice for anyone (as a sacrifice) after you
Sahih Muslim 1961i
Most scholars hold the first view, that this one-year-old goat or ewe does not suffice, meaning it is not permissible to offer it as a sacrifice, based on the statement of the Prophet (peace and blessings be upon him):
Do not slaughter except a mature animal, unless it is difficult for you, then slaughter a one-year-old from the sheep.
Sunan al-Bayhaqi 17:117
However, Shaykh al-Islam (may Allah have mercy on him) said: The intended meaning is that it will not suffice for anyone in a similar state, meaning that if someone finds himself in a similar situation, the ewe suffices for him and there is no harm. What Shaykh al-Islam (may Allah have mercy on him) said is the truth, because the Islamic Shari'ah cannot legislate for a specific individual simply because he is so-and-so, for example, Abu Burdah ibn Niyar. That is impossible. The Shari'ah is general and tied to descriptions and meanings. This is the legal principle: the Shari'ah is tied to descriptions and meanings, and it cannot be specific to a person. Do you understand? Good.
A person might come and say: Your principle is refuted by the many specific privileges of the Messenger of Allah (peace and blessings be upon him)? What is the answer?
The answer is that he was given this privilege because he is a Prophet and Messenger, and this description cannot exist after the Messenger. Is that clear? Therefore, this does not refute our position.
If someone were to say: You are refuted by the story of Salim, the freed slave of Abu Hudhayfah, because you do not hold that breastfeeding an adult has an effect, and you say this was specific to Salim, making it a privilege of the individual rather than a privilege of description. Is that clear? We say: Yes, if we said that, we have evidence, which is that the Prophet (peace and blessings be upon him) said:
The only suckling (to be considered) is that which gives life to the bones
Bulugh al-Maram 8:199
meaning there is no effective breastfeeding. This is one point.
Second: The Prophet (peace and blessings be upon him) said:
Beware of entering upon women.
Jami` at-Tirmidhi 1171Sahih (Darussalam)
meaning "beware of him." They said: "O Messenger of Allah, what about the maternal uncle?" He said:
The relative is death
If breastfeeding an adult had an effect, the maternal uncle would have been mentioned, saying: "He breastfeeds until we are safe from the calamity." But he did not say "beware of the maternal uncle" as he said "beware of death." So we have evidence.
However, we say that it is not specific to Salim himself, but specific to him because of his description, because Salim had been adopted by Abu Hudhayfah, so he was in the position of a son with him, entering his wife's presence and being at ease in his wealth and home, as if he were his son. It would be very difficult to say after that: "We forbid you from the house." Therefore, when the Prophet (peace and blessings be upon him) saw the hardship, he said:
Breastfeed him, and he will become prohibited for you
So we say: If a situation similar to Salim's is found, the ruling of Salim applies to it. And a situation similar to Salim's is impossible, why? Because adoption was abolished and invalidated in Islam. And thus, the principle established by Shaykh al-Islam, which is true, that no one can be given a specific legal ruling for himself, remains unrefuted, consistent, and without contradiction. So in the story of Abu Burdah, we say: If a person finds himself in a similar situation, slaughters his sacrifice before the prayer out of ignorance, and then has nothing but a small animal to sacrifice? We say: Sacrifice with it, and there is no harm, because his situation is like the situation of whom? Like the situation of Abu Burdah (may Allah be pleased with him). The wording is ambiguous, as the meaning could be "after your state." The broad and great principle is that no one is given a specific legal ruling for himself that prevents it from being specific to him as an individual. Yes. This is your companion saying: That is enough.
