The questioner : Is it permissible for us to give charity on behalf of one who does not pray and has died?

The Shaykh : Praise be to Allah, Lord of the worlds, and I send prayers and peace upon our Prophet Muhammad, and upon his family and his Companions, and upon those who follow them with excellence until the Day of Judgment:
It is not permissible for us to give charity on behalf of a person who does not pray and has died, because he is a disbeliever and charity does not benefit him. It is not permissible for us to do anything that would be a cause of forgiveness and mercy for him, because this is an encroachment upon Allah (Mighty and Majestic). Indeed, this man who died without praying will not be forgiven by Allah because he is a disbeliever. And Allah the Exalted said:
(113) It is not for the Prophet and those who have believed to ask forgiveness for the polytheists, even if they were relatives, after it has become clear to them that they are companions of Hellfire. (114) And the request of forgiveness of Abraham for his father was only because of a promise he had made to him. But when it became apparent to Abraham that his father was an enemy to Allah, he disassociated himself from him. Indeed was Abraham compassionate and patient. مَا كَانَ لِلنَّبِيِّ وَالَّذِينَ آمَنُوا أَنْ يَسْتَغْفِرُوا لِلْمُشْرِكِينَ وَلَوْ كَانُوا أُوْلِي قُرْبَى مِنْ بَعْدِ مَا تَبَيَّنَ لَهُمْ أَنَّهُمْ أَصْحَابُ الْجَحِيمِ * وَمَا كَانَ اسْتِغْفَارُ إِبْرَاهِيمَ لِأَبِيهِ إِلَّا عَنْ مَوْعِدَةٍ وَعَدَهَا إِيَّاهُ فَلَمَّا تَبَيَّنَ لَهُ أَنَّهُ عَدُوٌّ لِلَّهِ تَبَرَّأَ مِنْهُ إِنَّ إِبْرَاهِيمَ لَأَوَّاهٌ حَلِيمٌ
[At-Tawbah 9:113-114]
This includes seeking forgiveness for them during their lives and after their deaths.
And Allah (Blessed and Exalted is He) said:
And do not pray [the funeral prayer, O Muhammad], over any of them who has died - ever - or stand at his grave. Indeed, they disbelieved in Allah and His Messenger وَلا تُصَلِّ عَلَى أَحَدٍ مِنْهُمْ مَاتَ أَبَدًا وَلا تَقُمْ عَلَى قَبْرِهِ إِنَّهُمْ كَفَرُوا بِاللَّهِ وَرَسُولِهِ
[At-Tawbah 9:84]
Therefore, it is not permissible for us to seek forgiveness for one who died while not praying, nor to ask Allah for mercy for him, nor to give charity on his behalf, nor to benefit him in any way with matters of good. Rather, we are disavowed of him, and it is obligatory upon us to disavow him.
