What is your ruling on a man who entered his home and found that his wife had been forced into fornication, and he kept her and did not divorce her?

Machine translationRead the Arabic original
The questioner : May Allah preserve you, O Shaykh. A man is married to a woman from a wicked family, as the husband himself describes the state of her people. One day, the husband left his home, and upon his return, he found a sad and heartbreaking situation: a man had entered his wife’s home after she opened the door for him, thinking he was the son of one of the neighbors, and he committed fornication with her. The husband found marks of beating and strangulation on her, and she told him the truth, but he insisted on keeping her and did not divorce her. What do you advise this person to do with that woman, especially since the news has spread among the people? May Allah preserve you and reward you. He is known to be a person of good and righteousness and a caller to Allah.

The Shaykh : Praise be to Allah, Lord of the worlds, and may Allah send prayers and blessings upon our Prophet Muhammad, and upon his family and his Companions, and upon those who follow them with excellence until the Day of Judgment.
This incident is undoubtedly painful and sorrowful, and it has causes. Among its causes is the evil and calamity spread through the media, whether visual, written, or audio.
People have also expanded their listening to foreign media through satellite dishes, which are called "dishes." We ask Allah to protect the Muslims from their evil and to empower the state against their people so that it can put an end to them. The state has, praise be to Allah, issued a warning that it will put an end to these dishes. We ask Allah to help it in this and to hasten this matter before the evil and corruption spread.
Undoubtedly, the enemies of the Muslims spare no effort in turning Muslims away from their religion. If they can do so with weapons that kill souls, they do so, as is happening now in Bosnia and Herzegovina and other Muslim lands. If they cannot do that, they do it through destructive morals. When a person’s morals are destroyed, he becomes like a beast, with no concern except for enjoyment in this world, may Allah protect us from that. Allah said regarding the disbelievers:
but those who disbelieve enjoy themselves and eat as grazing livestock eat, and the Fire will be a residence for them. وَالَّذِينَ كَفَرُوا يَتَمَتَّعُونَ وَيَأْكُلُونَ كَمَا تَأْكُلُ الْأَنْعَامُ وَالنَّارُ مَثْوىً لَهُمْ
[Muhammad 47:12]
a bad end. If a young man or young woman sees these media outlets, they are absorbed into their hearts, and it becomes easy for them to practice them.
Also, among the destructive media outlets is that they invade people with bad, wicked, and deviant ideas, through which many people are led astray. For this reason, we advise our Muslim brothers in general to remove such fitnah from their homes, and to monitor their children, both sons and daughters. If they find a magazine that is inappropriate or destructive to morals, it is obligatory for them to burn it in front of the household, and to warn them against bringing back anything like it.
Likewise, in other means, if they see that the household members are insisting on it, they must prevent them. As for letting the rein hang loose, it entails great harm, such as the case mentioned by the questioner.
As for what concerns his wife, he says that he found marks of beating on her. This means that the woman, yes, this means that the woman did not do this of her own choice, and that this man, may Allah know best, knocked on her door and made her think he was one of her mahram relatives or kin, so he entered and what happened happened.
And as for her saying that she thought he was the neighbor’s son, she says so.

The questioner : Yes

The Shaykh : This is a mistake on her part. Even the neighbor’s son is not allowed to open the door for him. The neighbor’s son is like a relative of the husband, meaning: it is death. For this reason, when the Prophet (peace and blessings be upon him) warned against entering upon women, he said:
Beware of entering upon women. They said: O Messenger of Allah! What about the in-law? — meaning: relatives of the husband, such as his brother, his uncle, or his maternal uncle — He said: The in-law is death. إياكم والدخول على النساء، قالوا: يا رسول الله! أرأيت الحمو، -يعني: أقارب الزوج مثل أخيه وعمه وخاله- قال: الحمو الموت
meaning: flee from it as you flee from death, for it is calamity. Because if the in-law enters, and he enters the home of his relative, people do not find it objectionable, and he also sees that the matter is light, that entering the home of his relative is easy, so evil occurs. So we say to this woman: do not open the door to anyone ever except her husband, do not open the door to anyone ever except her husband or one of her mahram relatives. Then she should also be cautious, because some people are wicked and may imitate voices, so let her be cautious of this. What I see is that if this woman claims she was forced, as is apparent from her condition, which is evident from the question, she is excused and there is no sin on her. And if her husband keeps her with him, he is not a fool, but he is excusing her. It is not befitting for him to leave her because of this act that happened to her, and she was, may Allah know best, forced. As for the talk of people, no one is safe from it. People cursed the Messenger (peace and blessings be upon him) and cursed Allah (Mighty and Majestic). Yes, from the left, yes.
