The questioner : Shaykh, may Allah preserve you, an entire village in the south of the Kingdom was waiting for the Hajj season with great impatience until it would arrive, because they considered that their livelihood for the whole year and their work would not be except in this season. So they would go, every individual of this tribe, to a pilgrim they knew. These pilgrims come with the delegations and bring a substitute for pilgrims, meaning people who have died and did not perform Hajj, or people who are unable to perform Hajj, and they send financial amounts with these people. Then the individuals of this tribe would take these moneys, claiming that they have students of knowledge who perform Hajj on behalf of those who appointed them. They would take these moneys but they would not perform this obligatory duty. In fact, one of them would take [money] for up to two hundred or three hundred people to perform Hajj on their behalf under this claim. So what should they do, knowing that they have repented to Allah, the Exalted and Sublime? Is there anything required of them or not, may Allah preserve you?

The Shaykh : This is, in reality, a forbidden and shameful act. As for it being forbidden, they took money and did not perform the works for which they took the money, so it is consuming money by falsehood.
And as for it being shameful, their Muslim brother trusted them and relied on them to perform one of the obligations of Islam, so they betrayed him in that. The obligatory duty for these people after repentance is to count all the pilgrimages for which they took money and then perform Hajj with them.
