The questioner : He says: I performed the obligatory Hajj as a Qiran with 'Umrah, and I performed the Tawaf of 'Umrah two days before the standing at 'Arafah, and I completed the 'Umrah, then we stood on the day of the standing at 'Arafah, and then we spent the night of 'Eid in Mina. On the morning of 'Eid, after the 'Eid prayer, I performed the Farewell Tawaf on the day of 'Eid al-Adha. Then I returned and slaughtered the sacrificial animal for Allah, and I stoned the pillars on the day of 'Eid, the second day, and the third day of 'Eid. That is, I spent two nights in Mina after 'Eid. Then I left Makkah and exited the state of Ihram, but I was unable to return to the Ka'bah to perform Tawaf around it. So, does my Tawaf on the day of 'Eid suffice for the others? I ask you to inform us: are there any deficiencies in this Hajj of mine or not? May you have abundant thanks.

The Shaykh : Praise be to Allah, Lord of the worlds. This brother says that he performed Hajj as a Qiran, and then he performed his 'Umrah before standing at 'Arafah.

The questioner : Yes.

The Shaykh : And this action, meaning performing the 'Umrah before standing at 'Arafah, is not the action of the one performing Qiran, but rather it is the action of the one performing Tamattu'. In any case, he did well, because the one performing Qiran should change his intention to 'Umrah to become a one performing Tamattu', as the Prophet (peace and blessings be upon him) commanded his Companions who had not brought the sacrificial animals to do so. In this story, it is mentioned that he spent the night of 'Eid in Mina.

The questioner : Yes.

The Shaykh : And this is not permissible. It is obligatory to spend the night of 'Eid in Muzdalifah, except that it is permissible for the weak among people to depart from Muzdalifah at the end of the night, because the Prophet (peace and blessings be upon him) granted a dispensation for the weak to depart from Muzdalifah at night. As for others, it is obligatory for them to pray Fajr in Muzdalifah, because the Prophet (peace and blessings be upon him) stayed there until he prayed Fajr, and he went to al-Mash'ar al-Haram and stood there until it was very light, and he said to 'Urwah ibn al-Mudharris:
Whoever attends this Salat of ours, and stays here with us until departing, while he has stood during the night or the day before that at Arafat, then he has completed his Hajj and fulfilled his Tafath. من شهد صلاتنا هذه ووقف معنا حتى ندفع وقد ووقف بعرفة قبل ذلك ليلاً أو نهاراً فقد تم حجه وقضى تفثه
Jami` at-Tirmidhi 891Sahih (Darussalam)
.

The questioner : Yes.

The Shaykh : And this indicates the obligation of staying in Muzdalifah until the Fajr prayer. The other hadiths we referred to, which are the Prophet's (peace and blessings be upon him) dispensation for the weak to depart at night, indicate the permissibility of departing in case of need at the end of the night. This is what is taken from this brother's story of his Hajj, if he has accurately described it.
Thirdly, the brother mentioned that on the day of 'Eid he performed Tawaf for the Farewell, and he likely means by that the Tawaf of Ifadah, so he erred in naming it. This is evidenced by the fact that he said at the end of his question that he left Makkah and exited his Ihram and it was not possible for him to return for Tawaf around the House, which indicates that he erred in naming it when he said he performed the Farewell Tawaf on the day of 'Eid. So, if he intended with the Tawaf on the day of 'Eid the Tawaf of Ifadah, meaning the Tawaf of Hajj, then it is valid, and he has performed what is obligatory upon him of the Tawaf of Ifadah.

The questioner : Yes.

The Shaykh : As for his leaving Makkah without performing the Farewell Tawaf, this is an error. It is obligatory for him not to leave Makkah until he performs the Farewell Tawaf, because the Prophet (peace and blessings be upon him) commanded that and said:
No one should depart until his last act is at the House. لا ينفر أحد حتى يكون ءاخر عهده بالبيت
Musannaf Ibn Abi Shaybah 9:969
. However, he granted a dispensation for menstruating women and women with post-natal bleeding to leave without the Farewell Tawaf, based on the Prophet's (peace and blessings be upon him) statement to Safiyyah when she informed him that she had performed the Tawaf of Ifadah before menstruating; he said, "Then let her depart." And based on the hadith of Ibn 'Abbas:
The people were ordered to perform the Tawaf of the Ka`ba (Tawaf-al-Wada`) as the lastly thing, before leaving (Mecca), except the menstruating women who were excused. أمر الناس أن يكون ءاخر عهدهم بالبيت إلا أنه خفف عن الحائض
Sahih al-Bukhari 1755
. There is also a note remaining in the brother's story: he did not mention Sa'y in his Hajj, and the apparent state of his case is that he did not perform Sa'y. If the man remained on his Qiran, and by his previous statement in the beginning of his question that he performed the 'Umrah before standing at 'Arafah, he meant that he performed the acts of 'Umrah while remaining on the Qiran, then his first Sa'y suffices for him, because it was Sa'y after the Tawaf of Arrival. But if he meant that he performed the 'Umrah, meaning the actual 'Umrah, before the Tawaf, and he exited the state of Ihram between the 'Umrah and the Hajj, then the Sa'y of Hajj remains upon him, and he must return to Makkah to perform the Sa'y of Hajj.

The questioner : Yes.

The Shaykh : And in that case, it is not permissible for him to approach his wife until he performs Sa'y, because the second exit from Ihram is not achieved except by Sa'y. Yes.

The questioner : This is a message we received from France, and the sender says: Your son, 'Abd al-Rahman Muhammad al-'Asiri, France.
