Explanation of the Book of Fitnahs and Rulings-09b

Machine translationRead the Arabic original
The reciter: Ibn Numayr narrated to us, Muhammad ibn Bashir narrated to us, Isma'il narrated to us, Salama ibn Kahil narrated to us, from Ata, from Jabir ibn Abdullah, that he said:
It was reported to the Prophet (peace and blessings be upon him) that a man among his Companions had freed a slave boy of his as a manumission upon death, and he had no wealth other than him, so he sold him for eight hundred dirhams and then sent the price to him. بلغ النبي صلى الله عليه وسلم أن رجلاً من أصحابه أعتق غلاماً له عن دبر لم يكن له مال غيره فباعه بثمان مائة درهم ثم أرسل بثمنه إليه
.

The Shaykh : The *mudabbar* is the one whose master has tied his manumission to his death, saying, "You are free after my death." He is called *mudabbar* because he is freed in the aftermath of the master's life. The *mudabbar* is not freed unless he comes out of the one-third [of the estate]. Accordingly, the debt takes precedence over this manumission. For this reason, the Prophet (peace and blessings be upon him) sold a *mudabbar* to pay off a debt that was upon his master. This *mudabbar* is sold and the debt is paid, and it is not said that the manumission has a strong effect. We say this because this manumission does not take effect unless there is no debt upon his master; otherwise, he is sold for the debt.
