The questioner : The letter before us in this session, which we received from the sender, Madi Abu Saleh, says: If a man has intercourse with his wife and touches her, where the intercourse is sexual, and the time for prayer arrives, then he gets up, performs ablution, and then prays, is his prayer valid? Even though I had intercourse with my wife in bed and got up, meaning at night, and touched her, then the time for the Fajr prayer arrived, so I got up and performed ablution, where I performed the ablution completely, then I prayed. Is my prayer valid, or do I have to repeat it?

The Shaykh : If the intimacy necessitates the full ritual bath, then this prayer of yours is not valid, and you have to repeat it after the full ritual bath. And if this intimacy does not necessitate the full ritual bath, then your prayer is valid, because you performed ablution in a state where only ablution is obligatory for you.

The questioner : Yes.

The Shaykh : The intimacy that necessitates the full ritual bath is one of two things: either intercourse, and even if no emission occurs, whenever a man has intercourse with his wife, the full ritual bath becomes obligatory for him and for her, whether emission occurs from them or not, due to the hadith of Abu Hurayrah (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said:
When a man sits in between the four parts of a woman and did the sexual intercourse with her, bath becomes compulsory. إذا جلس بين شعبها الأربع ثم جهدها فقد وجب الغسل
Sahih al-Bukhari 291
Muslim added:
And even if he does not emit. وإن لم يُنزل

So whenever a person emits, the full ritual bath becomes obligatory for him, whether through intercourse, intimacy, remembering, or whatever it may be. Whenever he emits, meaning any flow of semen with desire, the full ritual bath is upon him. In this case, the full ritual bath may become obligatory for the woman without the man, or for the man without the woman, or for both of them together. If emission occurs from the man without the woman, then the full ritual bath is upon him alone, and not upon her.

The Shaykh : And if she emits without the man, then the full ritual bath is upon her, not upon the man.

The Shaykh : And if both of them emit, then the full ritual bath is upon both of them. And this case, as we have known previously, is if it is without penetration. As for penetration, it necessitates the full ritual bath for both of them, even if no emission occurs.
