The reciter: Hareen ibn Sa'd al-A'ili narrated to me, saying: Ibn Wahb narrated to us, saying: Sulayman ibn Bilal narrated to me, from Thawr ibn Zayd, from Abu al-Ghayth, from Abu Hurayrah, that the Messenger of Allah (peace and blessings be upon him) said: Sahih Muslim 89.
The Shaykh : This hadith is broader than the previous one, for the Prophet (peace and blessings be upon him) said:.
means: the destructive sins. First, when he was asked what they are, he said: , and this has been discussed previously.
And sorcery is of two types:
One type is done with the help and assistance of the jinn, and it is the greater of the two. It is what occurs in blowing on knots and the like. This is disbelief, meaning its practitioner becomes a disbeliever, and he must be killed to prevent his harm and because of his apostasy. Even if it is assumed that he repents, we kill him, because it is a fixed punishment (hadd), as came in the hadith:Jami` at-Tirmidhi 1460Da'if (Darussalam), except if strong evidence indicates that the man has abandoned this and repented with sincere repentance. In that case, we say his repentance is accepted. But if he merely says: , and no evidence appears, then it is not accepted from him.
The second type is done with compounded medicines, and this is lighter than the first. Therefore, many scholars said that it does not make one a disbeliever, because this is like one who aggresses against another with any kind of aggression. Both types are among the major sins; the first is the major sin of disbelief, and the second is a major sin less than disbelief.
The third is:Sahih Muslim 89, which the scholars refer to as the protected soul. They are four categories: the Muslim, the dhimmi (a non-Muslim under Muslim protection), the one with a treaty, and the one granted safe conduct. These are the souls whose killing Allah has forbidden, except for a just cause, except for a reason. It is permissible to kill a Muslim for a reason, such as if he kills another, or if he is a married man who commits fornication, or the like. This restriction Sunan Abi Dawud 4272Munkar (Al-Albani) restricts the general mention of killing the soul in the previous hadiths.
The orphan is the one whose father died before he reached puberty. The reason consuming his wealth is more severe than consuming the wealth of others is that he is an orphan, so he is a place of mercy, compassion, and tenderness. If someone dares to consume his wealth, this becomes greater than if he dared to consume the wealth of one who is not entitled to the mercy of an orphan. This is from one aspect. From another aspect, the orphan has no one to defend him, so people overlook him and consume his wealth, driven by greed.
And his saying:, he used the word "consuming," but the meaning is destroying the orphan's wealth by eating, burning, spoiling, or otherwise. But he used the word "consuming" because it is the most common form of benefit, or it can be said: because if consuming his wealth is among the major sins, then destroying it without any benefit is even more so.
Consuming usury or interest is also among the destructive sins. Usury or interest in language means increase, and in the Shari'ah it means excess or increase in things...
Avoid the seven noxious things. It was said (by the hearers): What are they, Messenger of Allah? He (the Holy Prophet) replied: Associating anything with Allah, magic, killing of one whom God has declared inviolate without a just cause, consuming the property of an orphan, and consuming of usury, turning back when the army advances, and slandering chaste women who are believers, but unwary.
The Shaykh : This hadith is broader than the previous one, for the Prophet (peace and blessings be upon him) said:
