Explanation of the Book of Marriage-20

Machine translationRead the Arabic original
The Shaykh : The author (may Allah have mercy on him) said, regarding: "what he transmitted from Ibn 'Abbas (may Allah be pleased with him):
the wife of Thabit b. Qais came to the Prophet
Mishkat al-Masabih 3274
"
: to the end of it.
Who is Thabit ibn Qays?
Thabit ibn Qays (may Allah be pleased with him) was one of the orators of the Prophet (peace and blessings be upon him), and indeed one of his poets. He held the praised status when the word of Allah the Exalted came down:
O you who have believed, do not raise your voices above the voice of the Prophet or be loud to him in speech like the loudness of some of you to others, lest your deeds become worthless while you perceive not.
[Al-Hujurat 49:2]
. He (may Allah be pleased with him) had a loud, high-pitched voice, so he hid in his house weeping, fearing that his deeds would be nullified while he was unaware. The Prophet (peace and blessings be upon him) missed him and said: أين ثابت؟ Where is Thabit? They said: O Messenger of Allah, he has not left his house since this verse came down: "O you who believe! Do not raise your voices above the voice of the Prophet, and do not be loud to him in speech as some of you are loud to others, so that your deeds may be nullified while you are unaware." So he sent for him and said to him: "You, meaning, are not like that. You will live with a good reputation, be killed as a martyr, and enter Paradise." !!!
Allah is greater; the one who fears is safe. This is because when he feared that his deeds would be nullified and he would be among the people of the Fire, he was made safe by the hand of the Prophet (peace and blessings be upon him).
For this reason, Shaykh al-Islam Ibn Taymiyyah cited him as an example in *Al-'Aqidah al-Wasitiyyah*, saying: "And they [the people of the Sunnah] do not testify to Paradise for anyone except for those for whom the Prophet (peace and blessings be upon him) testified, such as the ten and Thabit ibn Qays ibn Shammās" . So he is among those for whom Paradise is testified (may Allah be pleased with him).
He lived with a good reputation and was killed as a martyr.
: In al-Yamamah, in the war of al-Yamamah against Musaylimah the Liar, he was killed as a martyr. A man passed by him while he was dead and took his armor, meaning like taking war spoils illicitly. Then he went with it to his tent at the edge of the army and placed it under a large pot. Do you know what a large pot is? It is a ceramic vessel made of fired clay. He placed it under the pot. One of his companions saw him; one of the companions of Thabit ibn Qays saw him in a dream and informed him of the news. Thabit informed him, saying: "A man passed by me and took the armor and placed it under a large pot at the edge of the army, and around it was a horse neighing. So go to him." He also gave him a bequest, the type of which I do not recall now, either blood money, freeing a slave, or a debt upon him. When the man went in the morning, he found the matter as Thabit had described it. Glory be to Allah!! A dead man was shown this case. His bequest reached Abu Bakr (may Allah be pleased with him), and he carried it out. For this reason, it is said: "No bequest of anyone who made it after his death was carried out except the bequest of Thabit ibn Qays ibn Shammās" . Glory be to Allah, why?
Because there was a sign, a sign that testifies that this vision was true, which was his informing that the armor had been taken and placed under the large pot, and around it was a horse neighing.
Yes, and this is undoubtedly one of the miracles granted to a righteous person, one of the miracles granted to Thabit ibn Qays ibn Shammās. Thabit ibn Qays ibn Shammās, his affair with this woman is strange, strange. She disliked him and did not love him, and she was his wife. So she came to the Prophet (peace and blessings be upon him) saying to him:
O Allah's Messenger, I do not find fault with Thabit bin Qais (RA) in respect of character or religion
Bulugh al-Maram 8:114
: And this is her testimony:
"I find no fault with him": meaning she does not describe him with a fault in his character or a fault in his religion. But in his appearance, it did not please her; in his appearance, it did not please her. As for his character, he was among the best of men, and as for his religion, he was among the best of men. And sufficient for you as evidence of the goodness of his religion (may Allah be pleased with him) and his righteousness is this great fear that occurred to him when the noble verse came down. And sufficient for you also is that the Prophet (peace and blessings be upon him) testified to him for Paradise.
She said:
I do not find fault with Thabit bin Qais (RA) in respect of character or religion, but I dislike (and fear) that I might commit an act of Kufr fil-Islam (that which is contradictory to Islamic behavior).
Bulugh al-Maram 8:114
: "I dislike disbelief," meaning: disbelief in the husband, because the Messenger (peace and blessings be upon him) said to the women:
You are many to curse and to disbelieve your husbands
Sahih Ibn Hibban 13:115
meaning: you deny his favor.
So she is saying: I fear that I will be ungrateful to my husband in Islam and thereby commit a sin.
And it was said: that the intended meaning is that I dislike disbelief, i.e., apostasy from Islam.
in Islam.
If she remains with him against her will. But this interpretation is weak and far-fetched, meaning it is far-fetched for a woman from the Companions to apostatize simply because she remained with a husband she disliked; this is far-fetched. But the correct view is that she disliked being ungrateful to her husband.
And there is no doubt that being ungrateful to the husband is a sin, and if the woman persists in it, it becomes one of the major sins, so she disliked this.
But I dislike disbelief in Islam. So the Prophet (peace and blessings be upon him) said: "Will you return his garden to him?" She said: "Yes."
Musannaf Abd al-Razzaq 17:796
:
Will you return his garden to him?
: The garden is an orchard. And Thabit had given her an orchard as her bridal gift, an orchard with palm trees and crops, yes. And the discussion of this issue and this point will come, if Allah wills.
She said: Yes.
Meaning, return his garden to him, to the end of the hadith.
It seems some of you want to ask, yes?
The student: If we know the state of the husband, that his wife loves him, and the wife wants to seek khul' ...

The Shaykh : Yes, this is one of the needs, without a doubt. This is more severe than many needs.
The student: O Shaykh, is the consent of the wife required?

The Shaykh : Yes, it brings us benefits.
