This message reached us, and it says: I and my brother were working in the city of Riyadh, and after we obtained our licenses, we went to our father in Hail. After we arrived there, a party took place one night at the home of our colleagues in Hail, and we accepted their invitation. After the party ended, it was late at night, so we entered our father's house and slept in the sitting room. My brother had a wife, but he left her and slept beside me in the sitting room. After a while, our father came in and was angry with my brother. He said to him, "Get up from here and sleep with your family." My brother refused, and after a short argument, my brother divorced his wife. This angered our father, and he swore that if she left the house, you would not spend the night with me. So his brother's wife left, and we left in obedience to his oath. He also forbade us from offering the 'Id sacrifice or eating dinner with him. We are now far from him and have not entered his house until now. To the honorable one who answers this question: What is the solution in such a case? Is there an expiation, or do we remain like this for the rest of our lives with our father? Or what should we do?

The Shaykh : The truth is that this was not a proper or correct action. Your brother, when his father ordered him to get up and sleep with his family, should have obeyed his father first, because obedience to the father is obligatory, provided it does not involve disobedience to Allah the Exalted or harm to the son. Here, there is no harm to the son, and it is not disobedience to Allah, but rather a matter of his commitment to obeying Allah.

The questioner : Yes.

The Shaykh : And this includes treating his wife with kindness, and there is no doubt that sleeping with his wife is part of treating her with kindness.

The questioner : Yes.

The Shaykh : Therefore, the son's action was bad and not befitting. As for the father, it is also not befitting for him to swear that they should not stay, or that the sons should not enter his house, or that they should not offer the 'Id sacrifice or eat dinner for him. This is also something that is not befitting. When the harm occurred through the son's divorce of his wife, it would have been better for the father to order his son to take her back, because this divorce was in anger, and regret is the norm in such cases. If he takes her back, the danger is removed, and the cause for which the father was angry is removed.

The questioner : Yes.

The Shaykh : But the matter now is that we are facing a reality. We say that if the wife has not completed her waiting period, it is better for the husband to take her back. As for the father's oath, the oath, praise be to Allah, has an expiation. He can feed ten poor people or clothe them. If he does not find the means, and this is rare in our time, praise be to Allah, then he fasts for three days.

The questioner : Yes.

The Shaykh : So the solution now, regarding the wife, is for her husband to take her back as long as she is in the waiting period. And regarding the father's oath, the father should expiate for this oath by feeding ten poor people, and then the sons should return to their father's house.

The questioner : Yes.

The Shaykh : Yes.
