The questioner : He says: I am twenty-two years old, I am married, I fasted last Ramadan, and on one day of Ramadan I prayed Fajr and returned from the mosque to my house after the prayer. Then Satan overcame me and tormented me, and I had intercourse with my wife while I was not aware of myself. What is the ruling on this matter? Please inform us, may Allah grant you success and protect you, and thank you?

The Shaykh : Praise be to Allah, Lord of the worlds, and may peace and blessings be upon our Prophet Muhammad, and upon his family and all his Companions. There is no doubt that the brother questioner has realized that intercourse with a fasting person during the day of Ramadan is forbidden and a grave matter. He mentions that he had intercourse with his wife and was not aware of himself. If by his statement "I was not aware of myself" he means that he had intercourse with her while he was sleeping or between sleep and wakefulness, and he did not know what he was doing, then he owes nothing, because he did not know what he was doing. But if his intention is that his self overcame him and suppressed his intention and will until he did what he did, then he must repent to Allah, the Exalted, from this matter and fast two consecutive months if he is able. If he is not able, he must feed sixty poor people. The ruling for his wife is the same as his ruling if she was willing. If she was forced, then she owes nothing. This is based on the hadith of Abu Hurayrah regarding the story of the man who came to the Prophet (peace and blessings be upon him) and said: "O Messenger of Allah! I am ruined." He said:
And what ruined you? وما أهلكك؟
He said: I came to my family in Ramadan while I was fasting. He said:
Do you have a slave to free? هل تجد رقبة؟
He said: No. He said:
Can you fast for two successive months? هل تستطيع أن تصوم شهرين متتابعين؟

Can you feed sixty poor persons?" He said, "I have nothing." هل تستطيع أن تُطعم ستين مسكيناً؟ قال: لا

This indicates the obligation of the expiation in this order: freeing a slave, and if he does not find one, then fasting two consecutive months, and if he is not able, then feeding sixty poor people. Yes.
