The questioner : He says, "My problem, O honorable Shaykh, is that I was married in the month of Sha'ban last year, and when the noble month of Ramadan arrived, he said, 'I could not control myself during the time of fasting and had intercourse with his wife, and she is now pregnant. He says, 'Advise us, may Allah reward you with good. What should I do so that Allah forgives me? And is there anything wrong with this pregnancy?'"
The Shaykh : As for the pregnancy, there is nothing wrong with it.
As for intercourse during the day in Ramadan, when a person is resident in his country and it is obligatory for him to perform the fast at its proper time, and he knows that it is forbidden, then the expiation is required, which is: freeing a slave. If he does not find one, then fasting two consecutive months. If he is unable to do so, then feeding sixty people. This is what is established from the Prophet (peace and blessings be upon him).
Therefore, the one who commits this act must perform the expiation as stated in the hadith: freeing a slave, meaning freeing a slave. If he does not find one, then fasting two consecutive months. If he is unable to do so, then feeding sixty poor people. The woman is like him, except if he forced her, in which case she owes nothing.
