Q: What is the ruling for one who proceeds in a defective Hajj and then dies?

A: He is treated in the same manner as one who dies in a valid Hajj: he is shrouded in his two garments, he is not perfumed, and his face and head are not covered. This is based on the hadith of Ibn Abbas (may Allah be pleased with him and his father) regarding the man who fell from his mount and died while in the state of ihram, in which the Prophet (peace and blessings be upon him) said:
Wash him with water and sidr, shroud him in his two garments, do not apply tahnit to him, and do not cover his face or his head, for he will be raised on the Day of Resurrection while reciting the talbiyah.اغسلوه بماء وسدر، وكفنوه في ثوبيه، ولا تحنطوه، ولا تخمروا وجهه ولا رأسه، فإنه يبعث يوم القيامة ملبيًا
