The Ruling on Zakah in Gold Purchased with the Intention of Using It for Adornment

Machine translationRead the Arabic original
Question:
Is zakah obligatory in the gold belonging to the wife and daughters, which was purchased with the intention of using it for adornment, or is zakah not obligatory in it?

Answer:
This is a matter in which the scholars (may Allah have mercy on them) differed; some of them made zakah obligatory in it due to the generality of the evidence and specific proofs, while others said that it is not obligatory because it is being used.
The correct view is that zakah is obligatory in jewelry if it reaches the nisab, even if it is being used; due to the generality of his (peace and blessings be upon him) saying:
If any owner of gold or silver does not pay what is due on him, when the Day of Resurrection would come, plates of fire would be beaten out for him; these would then be heated in the fire of Hell and his sides, his forehead and his back would be cauterized with them.
Sahih Muslim 987a
the hadith.
And because it is established from him (peace and blessings be upon him) that a woman came to him and on her daughter's hand were two bracelets of gold—meaning two gold bracelets—and he said:
Do you give the zakah of this?
She said: No. He said:
Are you pleased that Allah may put two bangles of fire on your hands?
Sunan Abi Dawud 1563Hasan (Al-Albani)
So she threw them down and said: They are for Allah and His Messenger.
The point is that jewelry falls within the generality of the evidence indicating the obligation of zakah in gold and silver. Among this is the hadith of Umm Salama: that she used to wear ornaments of gold, so she said: O Messenger of Allah, is it a treasure? He said:
Whatever reaches the amount where zakah is due, if zakah is paid on it, it is not a treasure.
, and he did not say to her: There is no zakah in it.
As for the hadith
There is no zakah on jewelry
Musannaf Ibn Abi Shaybah 4:383
, it is a hadith that is not authentic from the Prophet (peace and blessings be upon him).
In summary, the correct of the scholars' opinions is that there is zakah in jewelry of gold or silver if it reaches the nisab. The nisab is twenty mithqals, and the amount of that in the Saudi riyal is eleven and three-sevenths of a riyal. And of silver, it is (140) mithqals, and the amount of silver zakah in the Saudi riyal is (56) riyals of silver and its equivalent in currencies. If the jewelry reaches this amount, it is obligatory for its owner to pay zakah when a lunar year has passed over it. The obligatory amount is one-quarter of one-tenth, so if the jewelry reaches ten thousand, in it are two hundred and fifty, which is one-quarter of one-tenth, and so on. This increases it and clears her conscience.
