I seek a ruling from your Eminence regarding this question: I married a girl, and she has been with me for about two years, and I have a daughter from her. Your Eminence, my wife then informed me that she had performed the rites of 'Umrah with her family and circumambulated the Sacred House, and her menstruation was with her. Your Eminence, after she told me this, I raised this question with Your Eminence, Shaykh Saleh ibn Faraj in the 'Aqif province, seeking a ruling in this matter to clear her conscience, and whether anything is required of her because of it. He answered me, may Allah reward him with good, that the wife should repeat the 'Umrah. Your Eminence, she performed this 'Umrah four years before I married her.

And upon you be peace, and Allah’s mercy and blessings, and after that:
If the situation is as you have described, it is obligatory for her to go to Makkah and perform the circumambulation and the sa'y for her 'Umrah, and to shorten her hair. She must also sacrifice an animal in Makkah for the poor on account of your intercourse with her while she was in the state of ihram and had not exited from her 'Umrah; because her circumambulation while menstruating is invalid. She must also repeat the 'Umrah from the miqat; because the first one was invalidated by the intercourse. Thus, the obligatory acts are to perform the works of the first 'Umrah, which are the circumambulation, the sa'y, and shortening the hair, and then a second 'Umrah from the miqat, as some of the Companions of the Prophet (peace and blessings be upon him) issued a ruling to that effect. It is forbidden for you to approach her until the contract is renewed—I mean the marriage contract—after she has done what we mentioned, along with repentance to Allah (Glorified and Exalted is He) for that. May Allah guide everyone to what He is pleased with, and peace be upon you and the mercy of Allah and His blessings.
