Q: I performed 'Umrah with my family in the year 1408 AH, and I entered the state of ihram for 'Umrah while I was menstruating. After arriving in Makkah , I performed tawaf around the Ancient House while still menstruating. Then, I did not perform sa'y between al-Safa and al-Marwah because I was not convinced by what I had done. I then returned with my family. In the year 1410 AH, I performed 'Umrah again with my family, but I did not intend it as making up for the first 'Umrah; rather, I intended it as a new 'Umrah. In the year 1414 AH, I got married, my husband consummated the marriage, and I bore him a son. I contacted the Department of Ifta , and they informed me that I should consult your eminence to formalize my inquiry and send it to them. Therefore, I request a ruling on the aforementioned 'Umrah: does my second 'Umrah serve as a substitute for the first? Have I been released from my ihram by my second 'Umrah? Am I now required to make up my first 'Umrah from the year 1408 AH, or not? Is my marriage contract valid or defective? If it is defective, what is the course of action? I hope you will forward my inquiry to His Eminence the Grand Mufti of the Kingdom of Saudi Arabia for a ruling on what is required by the Shari'ah. We therefore ask your eminence to issue a fatwa based on what you consider to be in accordance with the Shari'ah. May Allah
preserve and protect him.

A: The second 'Umrah is considered the completion of the first 'Umrah, not a make-up for it; because you were still in the ihram of the first 'Umrah. Since you have performed the rituals of 'Umrah in their entirety, you have been released from this ihram, and it became permissible for you to marry. Thus, your marriage contract is valid, and praise be to Allah, and you owe nothing in this matter. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
