Question: This sacrificial animal that is offered but not utilized, except for a little, is it not better for the pilgrim who is able to offer the sacrifice to fast, and upon his return to give the value of the sacrifice to the poor of his country, and then complete the fasting of the remaining ten days? What is your opinion? May Allah reward you.

Answer: It is known that the laws are received from Allah and His Messenger, not from the opinions of people. Allah, Glorified and Exalted is He, has prescribed for us in Hajj that if the pilgrim is performing tamattu' or qiran, he must offer a sacrifice. If he is unable to offer the sacrifice, he fasts ten days; three of them during Hajj, and seven when he returns to his family. It is not for us to legislate anything on our own. Rather, it is obligatory to rectify the corruption that occurs in the offering of the sacrifice by mentioning it to the authorities so they can manage the meat and distribute it to the poor and needy, and by paying attention to the slaughter areas, expanding them for the people, and increasing their number in the Haram; so that the pilgrims can slaughter in ample times and in ample places. And it is upon the authorities to transport the meat to those who are entitled to it, or to place it in refrigerated areas so that it can be distributed later to the poor in Makkah and elsewhere.
As for changing the system of the sacrifice; by fasting while he is able, or buying a sacrifice in his country for the poor, or distributing its value, this is a new legislation that is not permissible for a Muslim to do; because the Legislator is Allah and no one has the right to legislate
Or have they other deities who have ordained for them a religion to which Allah has not consented? But if not for the decisive word, it would have been concluded between them. And indeed, the wrongdoers will have a painful punishment.أَمْ لَهُمْ شُرَكَاء شَرَعُوا لَهُم مِّنَ الدِّينِ مَا لَمْ يَأْذَن بِهِ اللَّهُ وَلَوْلَا كَلِمَةُ الْفَصْلِ لَقُضِيَ بَيْنَهُمْ وَإِنَّ الظَّالِمِينَ لَهُمْ عَذَابٌ أَلِيمٌ
[Al-Shura: 21].
Therefore, it is obligatory upon Muslims to submit to the law of Allah and to implement it. And if a defect occurs from people in its implementation, it is obligatory to rectify it and pay attention to it, just as has occurred with the sacrifice in the slaughter of some of the sacrificial animals, and the absence of anyone to eat them. This is a defect and an error, and it must be treated from the side of the authorities and from the side of the people.
So every Muslim should take care of his sacrificial animal, so that he distributes it to the poor, or eats it, or offers it to some of his brothers. As for leaving it in places where it is not utilized, that does not suffice him. And so with the slaughterhouse, it is obligatory upon the owner of the sacrificial animal to take care of this matter, and to strive with all effort to distribute it if possible. And it is upon the authorities to assist in that; by transporting the meat to the poor at the right time, or transporting it to refrigerated areas; so that it can be utilized later and does not spoil. This is what is obligatory upon the authorities, and they are, if Allah wills, working on this matter. And the scholars continue to advise about it, and they remind the authorities of this matter.
And we ask Allah to help everyone with what is in the public interest of Muslims in this matter and others.
