The Ruling on Divorce by Three Consecutive Words
Machine translationRead the Arabic original
Question: From Abdulaziz ibn Abdullah ibn Baz to the honorable brother, the esteemed Shaykh, the Assistant Head of the Courts of the Jazan Region, may Allah grant him understanding in all good, amen.
Peace be upon you, and Allah's mercy and blessings. After that:
O Beloved, your noble letter (607) dated 24/3/1392 AH has been received, may Allah guide you. I have reviewed the attached documents regarding the divorce of husband H from his wife. Among them is the document containing his confession before the esteemed Shaykh, the Assistant Head of the Courts of the Jazan Region, that he divorced her by saying: "Talaq, then talaq, then talaq," without being aware of it, due to his intense anger with her, according to his statement. Also included is the document containing her attendance with her father before the esteemed Shaykh, the judge of Dhahr al-Janub, appointed in al-Harjah, and her confession that the aforementioned husband said to her, because of her crying over the hour he had missed: "You are talaq, you are talaq, you are talaq," three times.
Answer: Based on this, and on the husband's confession to me of what was mentioned above, and the lack of proof for his claim of altered sensation, I issued a fatwa to him that he has no way to return to her until she marries another husband; because he has exhausted the three divorces with consecutive words, and thereby she has become divorced from him with a major final divorce. Therefore, I ask your eminence to notify her guardian of this and to complete what is obligatory. May Allah guide everyone to what pleases Him.
And peace be upon you and the mercy of Allah and His blessings.
