Peace be upon you, and Allah’s mercy and blessings. To proceed:
Your noble letter dated 9/3/1389 AH has reached me, may Allah guide you, containing your report of a dispute between you and your wife, which led you to leave your home. You stated that when you wanted to bring her back to your home, she said, “You have no intention toward me except for sleeping with me”—meaning intercourse—and that you became angry at that, so you said to her, “Return to your home, and sleeping with you is forbidden.” Your question regarding the ruling on this was clear.
Answer: From Abdulaziz ibn Abdullah ibn Baz, to the honorable brother A. M. T. A., may Allah grant him success in all good. Amen.
Peace be upon you, and Allah's mercy and blessings. As for what follows:
Your noble letter dated 9/3/1389 AH has reached me, may Allah guide you, containing your report of a dispute between you and your wife, which led you to leave your home. You stated that when you wanted to bring her back to your home, she said, “You have no intention toward me except for sleeping with me”—meaning intercourse—and that you became angry at that, so you said to her, “Return to your home, and sleeping with you is forbidden.” Your question regarding the ruling on this was clear.
The answer is: It is not permissible for you to declare forbidden what Allah has made lawful for you. You must repent and seek forgiveness from Allah for this, and refrain from repeating such an act.
Your wife is lawful for you, and your words do not make her forbidden to you.
You are obligated to pay an expiation for an oath for your statement, “Sleeping with you is forbidden”—if the situation is as you described. The expiation is feeding ten poor people, each receiving half a sa’ (a dry measure of about 3 kg) of dates, rice, or barley. If you provide them with a breakfast or a dinner, that is sufficient.
The sa’ referred to is the sa’ of the Prophet (peace and blessings be upon him), and its measure is four full handfuls with two moderate hands.
May Allah grant all understanding of the religion and steadfastness upon it; indeed, He is Generous and Noble.
And peace be upon you and the mercy of Allah and His blessings.
