The right of pre-emption: if your partner in a piece of land sells it, you have the right to take it from the buyer. He says, "The right of pre-emption is not obligatory except in land," based on his statement, "When rights are established and paths are diverted, there is no pre-emption," even though the beginning of the hadith states that the Prophet (peace and blessings be upon him) ruled with the right of pre-emption in everything that had not been ruled upon. So they specify the generality by the cause or by the ruling in some of the opinions. We say that the apparent view is that a person should not dip his hand in the vessel when he wakes up from sleep, whether it is at night or during the day. This is the most common and the best.
