The Shaykh : In the name of Allah, the Most Gracious, the Most Merciful:
The author al-Nawawi (may Allah have mercy on him) said in his book *Riyad al-Salihin*, in the chapter: Gentleness, Forbearance, and Deliberation, in the context of the hadiths reported on that matter, he quoted from Shaddad ibn Aws (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said:Jami` at-Tirmidhi 1409Sahih (Darussalam) : He prescribed it in all things, meaning in every thing, He prescribed excellence in every thing, meaning that Allah (Mighty and Majestic) legislated excellence in every thing, even in killing, even in slaughtering, and other matters, that you should be excellent in what you do. Jami` at-Tirmidhi 1409Sahih (Darussalam) : And that is because the taking of souls is sometimes by killing and sometimes by slaughtering. If it is in what is lawful, it is slaughtering and neck-cutting; and if it is in what is not lawful, it is killing. So slaughtering and neck-cutting are done in what is lawful, meaning: in what is eaten. Neck-cutting is for camels, and slaughtering is for everything else. Neck-cutting is for camels, and slaughtering is for everything other than camels, in everything other than camels. Neck-cutting is at the lower part of the neck, near the throat, near the chest, and slaughtering is at the upper part of the neck, near the head. And it is necessary in slaughtering and neck-cutting, it is necessary to cut the two carotid arteries, which are the two thick vessels from which the blood flows and is distributed to the rest of the body. Because the Prophet (peace and blessings be upon him and his family): Sahih al-Bukhari 2507 : And the blood does not flow except by cutting the two carotid arteries. So the condition for the lawfulness of the slaughtered animal, meaning the one neck-cut, is that the two carotid arteries are cut. As for the windpipe, which is the passage of the breath, and the esophagus, which is the passage of food, cutting them is more perfect in slaughtering and neck-cutting, but that is not a condition. And as for killing, it is in what is not lawful to eat, in what one is commanded to kill, and in what one is permitted to kill. So in what one is commanded to kill: one is commanded to kill the mouse, to kill the scorpion, to kill the snake, to kill the biting dog. So these things are killed, and likewise every harmful thing, it is killed.
