Explanation of the Book of Marriage-12

Machine translationRead the Arabic original
The Shaykh : Then he said: "And from Jabir (may Allah be pleased with him), he said:
the Jews used to say: When a man has intercourse with his wife through the vagina but being on her back. كانت اليهود تقول إذا أتى الرجل امرأته من دبرها في قبلها
Sahih Muslim 1435a
"
:
The Jews used to كانت اليهود
: The Jews are a people who resided in Madinah, and they are from the Children of Israel, and among the most extreme of people in transgression, oppression, ignorance, and foolishness.
These people in Madinah were three tribes: Banu Nadir, Banu Qaynuqa, and Banu Qurayzah.
The reason for their descent into Madinah was that they read about the description of the Prophet (peace and blessings be upon him) that he would migrate to a salty land, and they found that in their books, and they wished or hoped that he would be from the Children of Israel, so they migrated to Madinah and settled in it. And whenever there was talk or skirmishes between them and the Ansar of Aws and Khazraj, they would seek help against them and say: "A Prophet will be sent among us by whom we will be victorious over you,"
when there came to them that which they recognized, they disbelieved in it فلما جاءهم ما عرفوا كفروا به
[Al-Baqarah 2:89]
: and they refuted his statement. So the Jews were integrated with the Ansar of Aws and Khazraj, and they would tell them what they told them from what they had of the Torah, so they would say: If a man approaches... to the end.
And they were named Jews: either from their saying:
indeed, we have turned back to You إنا هدنا إليك
[Al-A'raf 7:156]
meaning: We have returned.
Or it is a reference to their father Yehuda ibn Ya'qub, and this is the origin, this is the most correct, that it is a reference to their father, and it is not from the category of
indeed, we have turned back to You إنا هدنا إليك
[Al-A'raf 7:156]
.
the Jews used to say: When a man has intercourse with his wife through the vagina but being on her back. the child will have squint تقول إذا أتى الرجل امرأته من دبرها في قبلها كان الولد أحول
Sahih Muslim 1435a
The Jews say: The child will be strabismic. And who is the strabismic?
The strabismic is the one whose black of the eye has turned to one side, either to the nose or to the temple, meaning: either to the right side or the left side, and strabismus is a defect.
And among the strange things is that some poets said, when one of the Caliphs was looking at the sun, and the Caliph was strabismic, he said:
"And the sun has almost, and it has not yet done *** As if it is in the horizon the eye of the strabismic"!
"The sun has almost": meaning it was about to set.
"And it has not yet done *** As if it is in the horizon the eye of the strabismic"!
The eye of the strabismic: the strabismic sees the black of the eye sinking to one side if the strabismus is severe. They say: The Caliph was enraged, he said: How is this? Insulting the Caliph, praising and saying: It is as if it is in the horizon the eye of the strabismic.
So the result is that strabismus is undoubtedly a defect, but from the grace of Allah upon us is that in this time Allah has opened up for the doctors to correct this strabismus with an operation they perform, and balance between the two sides of the eye so that the eye is centered.
And the question here: Is this operation permissible or not permissible?
The student: It is permissible without detail.

The Shaykh : It is permissible without detail, meaning even if it leads to death?
The student: No.

The Shaykh : In any case, it is permissible without harm, and there is no harm now, praise be to Allah, so it is permissible because it is from the category of removing a defect, and not from the category of tattooing, branding, and filing teeth, because the latter is beautification, and the former is removing a defect, is there not a difference between beautification and removing a defect?
And for this reason, the Prophet (peace and blessings be upon him) permitted the man whose nose was cut off to make a nose from silver, then it became foul-smelling, so he permitted him to make it from gold.
Now, since we are on this topic, you will find in the books of the jurists -may Allah have mercy on them- that it is forbidden to cut off hemorrhoids, why?
Because in their time it was dangerous, but now it has become very easy and there is no danger. You will find in some books that it is forbidden to open the abdomen to sew a hernia, why?
Because at that time there was danger, perhaps blood would flow and he would die, but now the matter has become easy and facilitated. You will find in the books of the jurists: It is forbidden to cut off the extra finger, some people have six fingers in the hand or in the foot, so they say: It is forbidden to cut off the extra finger, why?
Because of the danger, the danger that existed, but now the matter is easy, praise be to Allah.
And on this basis, we say: The ruling revolves with its cause, in existence and absence. So as long as the danger has disappeared, then these things that the scholars mentioned as forbidden become permissible, valid, yes?
The student: We said that if there is no harm, it is permissible.

The Shaykh : Yes.
The student: Now... meaning ugly...!

The Shaykh : Ugliness is the loss of beauty, ugliness is the loss of beauty and not a defect.
The student: The teeth are raised.

The Shaykh : What?
The student: The teeth are raised.

The Shaykh : What are the raised ones?
The student: The teeth.

The Shaykh : The teeth are not to be corrected.
