Question:
From Jeddah, a message was sent by a listener (T. M. R) asking and saying: Is it permissible for my father to deprive me of what he leaves for us from his properties, and other things? And is it permissible for him to write everything in the name of our eldest brother? What is the ruling of the Shari'ah in this matter? May Allah reward you with good.

Answer:
Your father has no right to wrong you; rather, it is obligatory for him to be just in life and in death. The Prophet (peace and blessings be upon him) said:
Be afraid of Allah, and be just to your children.اتقوا الله، واعدلوا بين أولادكم
Sahih al-Bukhari 2587
So he has no right to bequeath to some of you and not to others, nor does he have the right to give to some of you and not to others in life. Rather, he must leave his wealth according to the law of Allah for everyone. If he makes a bequest, he should bequeath to everyone according to the shares of inheritance, neither increasing nor decreasing, but according to the shares of inheritance. And if he gives during his lifetime, it should be according to the shares of inheritance. As for singling out some of you and not others, this is not permissible; rather, it is an evil and a wrong. Yes.
