Ruling on a woman's guardian refusing to marry her to a man of good character and religion
Machine translationRead the Arabic original
This is a questioner from Jordan who has coded her name as (Z. H. M). She says in this question, Your Eminence: She mentions that she is a student, and a man of religion proposed to her. She asked to postpone the matter until after her final exams. Then another man of religion proposed, but her father refused and insisted on marrying her to a relative of hers who abandons prayer. She was forced, sought Allah's guidance, and entrusted her affair to Allah in obedience to her father. She married this man, but it was established that he does not pray, and he did not respond to her guidance. She says: So she separated from him; because she insisted that he pray, and he refused to pray.
And now she says: Whenever a man proposes to her, she does not get her share. So one of the brothers told her: You have been afflicted in your religion, because you did not respond to the saying of the Messenger (peace and blessings be upon him):Jami` at-Tirmidhi 1084Da'if (Darussalam) She says: So the affliction here is my lack of success in marriage; because I rejected a man of religion repeatedly. Is this my destiny? She says: What should I do, Your Eminence? Am I truly afflicted, even though I pledged to Allah that I would not accept anyone but a man of religion who prays and has good character, no matter the pressure? I ask Your Eminence to answer?
Answer: In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, and may Allah send blessings and peace upon the Messenger of Allah, upon his family and his Companions, and upon those who follow his guidance.
As for what follows:
So there is no doubt that it is obligatory for the believing woman to respond to Allah and the Messenger in matters of marriage and others. As for the two previous suitors whose religion and trustworthiness are acceptable, there is no doubt that marrying one of them was the appropriate thing, the thing that should be done, based on the hadith mentioned by the questioner:Jami` at-Tirmidhi 1084Da'if (Darussalam) But if the non-marriage was because of her father, and he refused and declined to marry her to them, then this sin is upon her father, not upon her; because she did not fall short. But if it was she who refused, then repentance is upon her. Repentance and returning to Allah and turning to Him is upon her. And whoever repents, Allah turns to him with mercy, Glorified and Exalted is He.
And as for her marriage to the one who does not pray, it is a mistake by her father, and a mistake by her; because the one who does not pray is a disbeliever, may Allah keep us safe. The Prophet (peace and blessings be upon him) said: And he (peace and blessings be upon him) said: Sunan Ibn Majah 1079Sahih (Darussalam) And the correct view is that it is major shirk. This is the stronger position among the statements of the scholars that it is major shirk.
So if she has been rid of him, praise be to Allah. Otherwise, it is obligatory that she does not return to him, and that she raise her matter to the court so that the court frees her from him by divorcing him; because it is not permissible for her to return to him while he is one who abandons prayer. And we ask Allah to make it easy for her a righteous husband, and to free her from this one who abandons prayer, if he has not divorced her. Yes.
The presenter: May Allah reward you with good, Your Eminence. Your Eminence! Is there any guidance for fathers who reject righteous husbands?
The Shaykh: Yes, it is obligatory for the guardian to choose for his ward a righteous man, and not to reject a righteous man for the sake of kinship or anything else. Rather, he must choose one whose religion and character he is pleased with, even if he is not a relative. This is what is obligatory for the guardian, whether he is a father or otherwise. And it is also obligatory for the woman to strive to accept a good suitor who is known for his religion and good character, and not to accept marriage to one whose religion and character she is not pleased with, even if he is a relative. Yes.
And now she says: Whenever a man proposes to her, she does not get her share. So one of the brothers told her: You have been afflicted in your religion, because you did not respond to the saying of the Messenger (peace and blessings be upon him):
When someone whose religion and character you are pleased with proposes to (someone under the care) of one of you, then marry to him. If you do not do so, then there will be turmoil (Fitnah) in the land and abounding discord (Fasad).
