Question:
The questioner says: A person performed Hajj as a mutamatti', and he carried out all the rituals—the rituals of Hajj—but he did not offer the sacrificial animal due to his circumstances. He resides in the Kingdom, and he was unable to fast due to his health conditions. Does this obligation fall off him? May Allah reward you with good.

Answer:
It is obligatory for him to offer the sacrificial animal, the hady of tamattu'. If he is unable to offer the hady of tamattu' and is unable to fast, it remains pending in his liability until he is able to do so. It remains pending in his liability like making up the fasts of Ramadan. It remains pending until he is able to offer the hady, in which case he offers it, or to fast, in which case he fasts. This is because Allah (Exalted and Majestic is He) made the hady obligatory upon him. He said:
then whoever performs 'umrah [during the Hajj months] followed by Hajj [offers] what can be obtained with ease of sacrificial animals. And whoever cannot find [or afford such an animal] - then a fast of three days during Hajj and of seven when you have returnedفَمَنْ تَمَتَّعَ بِالْعُمْرَةِ إِلَى الْحَجِّ فَمَا اسْتَيْسَرَ مِنَ الْهَدْيِ فَمَنْ لَمْ يَجِدْ فَصِيَامُ ثَلاثَةِ أَيَّامٍ فِي الْحَجِّ وَسَبْعَةٍ إِذَا رَجَعْتُمْ
[Surat al-Baqarah:196] So he should fear Allah and be mindful of Allah. If he is able to offer the hady, he sends it to Makkah and slaughters it there, or he appoints someone to buy it for him and slaughter it there. If he is unable and the inability to offer the hady continues, he fasts three days during Hajj and seven days when he returns. If the fasting is delayed, he fasts all of them with his family.
The point is: He has no right to be lax in this matter. Rather, he must either offer the hady if he is able, or fast. If he is unable to do both, the expiation remains in his liability until it becomes easy for him to do so.
If he dies and it did not become easy for him to do so, it is paid from his estate if he has an estate. It is bought from his estate and the expiation is paid on his behalf, because it is a debt in his liability. Yes.
