Question:
From the questions of the questioner Abu Abdullah, he says: Some of the elderly recite the beginning of al-Fatihah while sitting, then continue reciting al-Fatihah after standing up. What is the ruling on this action?

Answer:
If he is unable to stand fully, and can only manage partial standing, there is nothing wrong with him reciting the beginning of it, fearing that he will miss it if he delays it. However, if he is able to recite it while standing, he should delay it until he recites it while standing. But if he is unable to, and if he delays it, he may miss it, as the imam may bow before he finishes, then he recites part of it while sitting, then completes it while standing if he is unable. But if it is out of laziness and negligence, it is not permissible; he must hasten to stand, and it is not lawful for him to sit. If he sits, his prayer is invalid. But if he is unable, and has a valid legal excuse, and standing immediately is difficult for him, then this is a valid legal excuse for him.
And if he recites part of al-Fatihah because he is unable to recite it while standing, and the imam bows before him, there is nothing wrong; it is a valid legal excuse. Because Allah says:
So fear Allah as much as you are ableفَاتَّقُوا اللَّهَ مَا اسْتَطَعْتُمْ
[al-Taghabun:16] And the Prophet (peace and blessings be upon him) said to the one who is unable to pray standing:
offer prayer in standing condition; if you are unable to do so, then in sitting condition: if you are then at your sideصل قائمًا، فإن لم تستطع؛ فقاعدًا، فإن لم تستطع؛ فعلى جنب، فإن لم تستطع؛ فمستلقيًا
