Doctors and the Death of Patients in Surgical Operations
Question: Regarding the doctors who perform operations, if we suppose that one of the patients dies in their hands while they are performing the operation due to the operation itself, does anything attach to them in that regard, and are they obligated to pay an expiation?
Answer: If negligence on their part resulted in the person's death, or if the doctor was not skilled in performing the operation, then he bears responsibility in this matter, and he is obligated to pay the expiation, as well as the blood money to the deceased's kin; because this is considered accidental killing.
As for if the doctor is an expert in performing the operation, and the patient's condition could tolerate this, and no negligence occurred, then there is no blame on him in that, and he is not liable for compensation or expiation.
Question: If there was negligence and there was more than one person, meaning for example a doctor with an assistant or two assistants, are they all obligated to pay this expiation?
Answer: If the patient died due to negligence and carelessness on the part of the doctor and his assistant, then they all share in the responsibility, so they share in the compensation and the expiation, and Allah knows best.
[The Wisdom Behind the Prescription of Fasting]
Question: What is the wisdom behind the prescription of fasting? And how many Ramadans did the Prophet (peace and blessings be upon him) fast? And what is the meaning of: And is this a hadith:
Answer: As for the wisdom behind the prescription of fasting.
So fasting has great wisdoms, among them is the saying of Allah the Exalted: [al-Baqarah: 183], so the Exalted and Majestic made it clear that fasting is the cause for attaining mindfulness of Allah, and mindfulness of Allah is a great distinction, and it is the essence of all good. So the one who fasts acquires mindfulness of Allah, and fasting brings mindfulness of Allah to the servant in that when he fasts, he is trained in worship and disciplined to endure hardship, and to leave what is customary, and to leave desires, and he triumphs over his self which commands evil, and Satan stays away from him, and through this he attains mindfulness of Allah, which is doing the commands of Allah (Mighty and Majestic) and leaving His prohibitions seeking His reward and fearing His punishment. So this is among the greatest distinctions: that fasting causes the servant to have mindfulness of Allah (Glorified and Exalted is He), and mindfulness of Allah is the essence of all good, and it is the mother of righteousness, and it is that to which Allah has attached many blessings, and He has repeated the command for it in His Book, and He has praised its people, and He has promised much good for it, and He has informed that He loves those who are mindful of Him.
And among the benefits of fasting is that, as we mentioned, it trains the person to leave what is customary to draw near to Allah (Glorified and Exalted is He),For this reason Allah (Exalted and Majestic is He) says:, so this is a test for the one who fasts in that he left his desires, pleasures, and beloved things to draw near to Allah (Glorified and Exalted is He), preferring what Allah the Exalted loves over what his self loves, and this is the most eloquent type of worship, and this is among the greatest benefits of fasting.
And likewise, fasting trains the person in excellence in worship and in compassion for those in need and the poor, because when he tastes the taste of hunger and the taste of thirst, that softens his heart and makes his feelings gentle toward his needy brothers.
And fasting became obligatory in the second year of the Hijrah, and the Prophet (peace and blessings be upon him) fasted nine Ramadans, because he lived in Madinah for ten years and fasting became obligatory in the second of them, so it is that the one with peace and blessings be upon him fasted nine Ramadans, and the meaning of:
As for the one who was cupped, it is because a large amount of blood came out of him, so he broke his fast, because a quantity of blood was drawn from him, and this quantity weakens him and weakens his body, and he cannot bear fasting.
And the one who performed cupping broke his fast because it is a place where something of the blood might fly to his throat when he sucks the cup, and the place of possibility is treated as the reality, so the one who performed cupping broke his fast for that and to block the means to harm,This is the meaning of his saying (peace and blessings be upon him): ،Meaning: that the fasting of both of them was invalidated.
And the hadith:: This was reported from the Prophet (peace and blessings be upon him), and it is in some of the books of the Sunnah, and even if its chain is not strong, its meaning is correct, that fasting is health for the body because it prevents the humors that cause diseases, and this meaning is attested to by medical scholars, and experience is the greatest proof that fasting is health for the bodies.

So fasting has great wisdoms, among them is the saying of Allah the Exalted:
O you who have believed, decreed upon you is fasting as it was decreed upon those before you that you may become righteous -
And among the benefits of fasting is that, as we mentioned, it trains the person to leave what is customary to draw near to Allah (Glorified and Exalted is He),For this reason Allah (Exalted and Majestic is He) says:
Fasting is for Me and I will reward it for it, for he left his desire, his food, and his drink for My sake
الصوم لي وأنا أجزي به، إنه ترك شهوته وطعامه وشرابه من أجليAnd likewise, fasting trains the person in excellence in worship and in compassion for those in need and the poor, because when he tastes the taste of hunger and the taste of thirst, that softens his heart and makes his feelings gentle toward his needy brothers.
