The ruling on one who performed the farewell tawaf on the eleventh day and left Makkah
Machine translationRead the Arabic original
Question:
His second question says: O Shaykh, I performed Hajj in one of the past years with my wife. On the tenth and eleventh days, I stoned the pillars, and my wife stoned with me. Then I appointed a proxy to stone on my behalf and on my wife’s behalf for the twelfth day. I performed the farewell tawaf on the eleventh day and left Makkah before sunset. The reason for this was that I had a small child with me, who was extremely exhausted from the heat, had not eaten, had not been breastfed, and was crying a lot, which compelled us to do so. What is obligatory upon us?
Answer:
It is obligatory for you to sacrifice three animals. The first is for leaving off the stoning, because you have no right to appoint a proxy. The second is for leaving off the farewell tawaf, because you did not perform the farewell tawaf. The third is for leaving off staying overnight on the night of the twelfth. If you do not sacrifice for the night of the twelfth and instead give charity, that is sufficient, if Allah wills. However, sacrificing an animal is better, to be the third one. The first is for leaving off the stoning, because you have no excuse for leaving off the stoning on the twelfth day; the mother can keep the child, and the mother can take care of it. And you must sacrifice the second animal for leaving off the farewell tawaf, because the farewell tawaf is after the stoning, after the days of Mina have passed, after all the stoning is complete. And if you sacrifice a third animal for leaving off the night of the twelfth, for leaving off staying overnight on the night of the twelfth, that is better and more cautious.
As for her, she must sacrifice one animal for leaving off the farewell tawaf. Her appointment of a proxy is valid, because she has an excuse in the child that occupies her from stoning, and she cannot stone while the child is present. But she must sacrifice for leaving off the farewell tawaf, and for leaving off staying overnight, a second sacrifice is better, because she did not stay overnight on the night of the twelfth. If she sacrifices for it, that is better. And if she gives charity with something, that is sufficient, and praise be to Allah. We ask Allah for success for everyone. Yes. And the sacrifice is to be in Makkah; the animals are sacrificed in Makkah for the poor. Yes.
