The ruling on one who performed the farewell tawaf and then stayed in Makkah

Machine translationRead the Arabic original
Question:
At the beginning of this episode, we return to a letter from one of our brother listeners. He says: Salih Ahmad Ali al-Ghamidi, our brother. We presented part of his questions in a previous episode, and in this episode he has a number of other questions remaining. In one of his questions, he says: I performed Hajj last year, praise be to Allah, and when I performed the farewell tawaf, an hour before sunset, after the Isha prayer, I left, but due to an unintentional circumstance, I was delayed. Is anything required of me? I ask for guidance. May Allah reward you with good.

The Shaykh: Repeat.

The presenter: He says: I performed Hajj last year, praise be to Allah, and when I performed the farewell tawaf, an hour before sunset, after the Isha prayer, I was delayed due to an unintentional circumstance. Is anything required of me?

Answer:
In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, and may Allah send prayers and blessings upon the Messenger of Allah, and upon his family and his Companions, and upon those who follow his guidance. As for what follows:
It is established from the Messenger of Allah (peace and blessings be upon him) that he said regarding the pilgrims:
Let no one of you depart until his last visit is to the Houseلا ينفر أحد منكم حتى يكون آخر عهده بالبيت
Muslim narrated it in his Sahih. And Ibn Abbas (may Allah be pleased with him and his father) said: “The people were commanded to make their last visit to the House, except that this was made easier for the menstruating woman.” It is agreed upon by al-Bukhari and Muslim. The meaning of “The people were commanded” is: The Prophet (peace and blessings be upon him) commanded them.
Therefore, it is not permissible for the pilgrim to leave Makkah except after the farewell tawaf, if he intends to travel to his country, or to another country. And if he bids farewell before sunset and then sits after Isha for a need, or to listen to a lesson, or to pray Isha, there is no harm in that. A short duration is excused.
The Prophet (peace and blessings be upon him) performed the farewell tawaf in the Farewell Pilgrimage at the end of the night, then he led the people in the Fajr prayer, and then he traveled afterward (peace and blessings be upon him).
Therefore, a minor matter is excused. So if you traveled after Isha, there is no harm in that. But if you stayed for a long period until morning, you should repeat the farewell tawaf. If you did not repeat the farewell tawaf, there is no blame on you, if Allah wills; because although the duration had some length, it is forgiven, if Allah wills, due to ignorance of the obligation to hasten and rush to leave after the farewell tawaf. Yes.

The presenter: May Allah reward you with good.
