Question:
If a person forgets to recite al-Fatihah in the second or third rak'ah, does he have to repeat the prayer, or does that forgetting apply only to the first rak'ah?

Answer:
If he is the imam or praying alone, his rak'ah is invalid, and he must perform a rak'ah in its place and prostrate for forgetfulness. However, if he is a ma'mum, it is dropped from him, for the imam bears it on his behalf if he is forgetful. This is because when Abu Bakrah came and bowed while the imam was bowing, and then he entered the row, the Prophet (peace and blessings be upon him) did not order him to make up the rak'ah, and he said:
May Allah increase your eagerness! But do not do it again.زادك الله حرصًا، ولا تعد
Sunan Abi Dawud 683Sahih (Al-Albani)
This indicates that if one misses the standing, al-Fatihah is dropped from him. If he arrives while the imam is bowing, he has caught the rak'ah. So if he forgets it while standing with the imam, or if he is ignorant, he has caught the rak'ah and does not make it up, praise be to Allah, if he is a ma'mum. Yes.
