The ruling on one who prays the obligatory prayers except Fajr due to staying up late

Question:
What is the ruling on a person who prays all the obligatory prayers, but he leaves the Fajr prayer with the congregation because he is sleeping? I mean, he does not leave it every day, but on some days. What is his ruling? Does he have an excuse as long as he is sleeping late?
Answer:
He has no excuse, and sleep is not an excuse with due care. If it is difficult for him to sleep, he should take care: he should get up early and set an alarm clock by his head so that he can use it to help him. As for claiming sleep and being negligent, that is not an excuse. Sleep with negligence and without care is not an excuse.
The Prophet (peace and blessings be upon him) said:Sunan Abi Dawud 441Sahih (Al-Albani) meaning: with due care. When the Prophet wanted to sleep late on one of his journeys, he ordered Bilal to watch over the dawn. So it is not permissible for a person to be negligent and say: sleep is an excuse. He must leave staying up late and the causes that make him sleep through Fajr, and set the alarm near the adhan to help him with that, or instruct his good family members who get up to wake him. He has no excuse for being negligent in this matter. Rather, this is imitating the enemies of Allah, the hypocrites, so one must be cautious. The Prophet (peace and blessings be upon him) said: Sunan Ibn Majah 797Sahih (Darussalam), and Ibn Mas'ud (may Allah be pleased with him) said: "I have seen us, and none would be absent from it—meaning the congregation—except a known hypocrite. And indeed, a man would be brought, supported between two men until he stood in the row," meaning: he would be propped up until he stood in the row. It was narrated by Muslim in "Sahih."
So it is obligatory for the Muslim to fear Allah, and to be cautious of negligence regarding the congregation, not just the dawn prayer but others as well. And women likewise should fear Allah in all the prayers, and not delay the dawn prayer until after the sun rises. Rather, it is obligatory that it be performed in its time for men and women. But the obligation for men to perform it in congregation is increased. And it is obligatory for the woman to perform it in its time before the sun. Some people—may Allah protect us from that—delay the ghusl from janabah, so they do not take a bath until the late morning. They delay Fajr. This is a great affliction, and an imitation of the enemies of Allah, the hypocrites, so one must be cautious.

The Prophet (peace and blessings be upon him) said:
There is no remissness in sleep
ليس في النوم تفريطٌThe most burdensome prayers for the hypocrites are the 'Isha' prayer and the Fajr prayer. If only they knew what (reward) there is in them, they would come to them even if they had to crawl.
