The ruling on the statement that a woman is divorced if she insults her husband or his religion

Machine translationRead the Arabic original
The fourth question in the letter of the brother (H. A. S.) from Jordan says: If a Muslim woman insults her husband or her husband's religion, does she become divorced according to the Shari'ah, as we hear from most people? Please inform us, may Allah reward you.
Answer: If she insults her husband, no, she does not become divorced. However, she must repent to Allah and seek her husband's forgiveness. If he forgives her, there is no harm. If she insults him in return, just as he insulted her, and does not go beyond that, there is no harm. If he forgives her, that is better. For Allah says:
And to forego it is nearer to righteousnessوَأَنْ تَعْفُوا أَقْرَبُ لِلتَّقْوَى
[al-Baqarah: 237] and the Prophet (peace and blessings be upon him) said:
no one forgives another except that Allah increases his honorما زاد الله عبدًا بعفو إلا عزًا
Sahih Muslim 2588
.
As for insulting her husband's religion, and he is a Muslim, this is disbelief, may Allah keep us safe. If he is a Muslim and she is a Muslim and she insults her husband's religion, this is an insult to Islam, we seek refuge in Allah. So one should not be lenient with her; rather, she should be disciplined and struck for this bad action, and she should be asked to repent. If she repents from her bad action, otherwise she must be killed. It is obligatory for the one in authority, the judge of the land and the trustworthy man of the land, to ask her to repent. If she repents, otherwise she is killed; because insulting the religion, insulting Islam, is among the greatest types of disbelief and among the nullifiers of Islam, may Allah keep us safe. And so is insulting the Messenger (peace and blessings be upon him), insulting the Qur'an. Yes.
